This article is intended for the purposes of controlling existing and proposed outdoor signs of all types by regulating size, location, quantity, quality, content and design in order to:
A. 
Protect property values.
B. 
Create a more attractive economic business climate.
C. 
Enhance and protect the aesthetic environment of the town.
D. 
Provide a more aesthetically and environmentally enjoyable and pleasing community.
E. 
Reduce distractions to motorists caused by outdoor signs that may contribute to traffic accidents.
F. 
Reduce obstructions to motorists caused by outdoor signs that may contribute to traffic accidents.
G. 
Reduce hazards that may be caused by signs overhanging or projecting over public rights-of-way.

There shall be compliance with all of the regulations of Chapter 185 of the Code of the Village of Atlantic Beach, with respect to any sign which is proposed to be erected or maintained in the Village. The right to maintain any sign situated upon and affixed to a roof in violation of the provisions hereof or of Chapter 185 as a legal nonconforming use shall terminate by amortization on June 1, 2010.
The Board of Zoning Appeals may grant a special exception from the provisions of Chapter 185 of the Code of the Village of Atlantic Beach, after paying due consideration to the following factors:
A. 
The character of the district and vicinity.
B. 
The existence, location, size and nature of other signs in the vicinity.
C. 
Whether or not the sign is customarily essential to the primary use of the premises.
D. 
Whether the construction or location of the proposed sign will interfere with necessary light or air or impair property or aesthetic values or otherwise endanger the health and welfare of the public.
In addition to any and all proscriptions set forth in Chapter 185 of the Code of the Village of Atlantic Beach, there shall be no billboard which advertises commercial messages other than the use and operation of the on-site premises permitted in the Village, and no relief shall be considered for that purpose by the Board of Zoning Appeals.
