The Board of Trustees may from time to time after public hearing amend, supplement, change, modify or repeal this chapter, including the accompanying map or maps.
The Board of Trustees shall fix by resolution the time and place of any public hearing on the proposed amendment, supplement, change, modification or repeal of any part of this chapter, including the accompanying map or maps, and cause notice thereof to be given as provided by law.
A. 
Presentation of petition. Whenever the owners of 50% or more of the street frontage of the real property to which the subject matter of the application applies shall present to the Board of Trustees a petition duly signed and acknowledged requesting an amendment, supplement, change, modification or repeal of the regulations prescribed in this chapter or of the Official Zoning Map, including any district or part thereof, it shall be the duty of the Board of Trustees to hold a public hearing thereon and cause notice thereof to be given in the prescribed manner.
B. 
Filing fee. When any application is made pursuant to Subsection A above, the same shall be filed with the Village Clerk and shall be accompanied by a fee of $500.

C. 
Survey and area map. All applications and petitions for rezoning, zoning changes, use or otherwise shall be accompanied by at least six copies of a survey and area map, prepared and certified by a licensed land surveyor, showing the area to be rezoned as it exists on the date of filing such application and indicating the dimensions of all parcels of property located within a radius of 200 feet of the boundary lines of the property affected by said application or petition, complete with:
(1) 
Section, block and lot numbers.
(2) 
Names of fee owners thereof.
(3) 
Indication of whether such properties presently contain residential, commercial or other type structures erected thereon.
(4) 
Indication of the zoning districts of all lands shown on such map as of the date of filing of the application.
D. 
Public notice; hearing on application. Upon receiving an application or petition for a change of zone meeting the requirements of this article, the Village Clerk shall present said application or petition to the Board of Trustees at its next regular meeting for such action as the Board of Trustees may direct. If the Board of Trustees directs that a public hearing be held on such proposed amendment to the Code of Ordinances (Zoning Use Map), then said Board shall set a date and time on which such hearing shall be held, whereupon the Village Clerk shall cause a notice of such public hearing to be held by publishing the same in the official newspaper of the Village in the manner prescribed by law. The Village Clerk shall not be required to give any other notice except the publication hereinabove described.
E. 
Service of notice upon surrounding property owners. A notice on the form provided by the Board of Trustees shall be served by the applicant upon every owner of real property within a radius of 200 feet of the boundary lines of the property affected by said petition or application by registered or certified mail, return receipt requested.
F. 
Time for mailing notices to surrounding property owners. All notices provided for in Subsection E above shall be mailed not less than 10 days nor more than 20 days before the date set for public hearing upon such application or petition.
G. 
Execution; contents of notice to owners. Each notice sent pursuant to Subsection E above shall be signed by the petitioner or applicant, his agent or attorney, identifying the property affected thereby and setting forth the relief requested, and the date, hour and place fixed by the Board for a hearing thereon.
H. 
Consent in lieu of notice. In lieu of the notice upon owners entitled thereto as aforesaid, an applicant may submit a written consent to the relief requested by the applicant duly executed by any owner entitled to notice.
I. 
Affidavit of personal service in lieu of notice. In lieu of the mailing of notice to owners entitled thereto as aforesaid, an applicant may make personal service of notice, provided that such service is effected not less than 10 nor more than 20 days prior to the date set for hearing.
J. 
Filing proofs of service. Proofs of service in the form provided by the Board shall be filed with the Clerk at least five days before the date of the public hearing. The same shall consist of an affidavit of mailing with required return receipts attached thereto or an affidavit of personal service.
In case of a written protest against such proposed change, signed by the owners of 20% or more of the area of the real property included in such proposed change and/or the real property located within a radius of 200 feet of the perimeter of the real property included in the proposed change, such amendment shall not become effective except by the favorable vote of 4/5 of the members of the Board of Trustees.
