It is the intent of this article to prevent pollution and overcrowding of the waters and waterways within or adjacent to the Town of Huntington and subject to its jurisdiction and further to preserve and protect the health, safety and general welfare of the people of the Town of Huntington and the natural ecology of the waters and waterways of the Town of Huntington and the marshlands adjacent thereto.
This article regulates the use of vessels, as defined in § 120-2 of this chapter, in the Town of Huntington and shall apply to all waters within or bounding the Town to a distance of one thousand five hundred (1,500) feet from the shore and shall, with the consent of the incorporated village concerned, apply to the waters bounding such village by resolution of the Board of Trustees.
A. 
No person, corporation, firm, association, organization, owner or agent shall use or occupy a vessel that is berthed, moored or anchored within the waters of the Town of Huntington as a residence or dwelling or for sleeping or living quarters for more than fourteen (14) days in any one-month period. This provision shall not apply to users or occupants of vessels berthed, moored or anchored within the waters of the Town of Huntington as of the date of passage of this article, which said users or occupants and their vessels presently comply with all applicable laws, rules, regulations, ordinances and codes of the town, county, state and federal governments.
B. 
Such limited and intermittent use, as permitted in Subsection A of this section, shall be in compliance with all applicable laws, rules, regulations, ordinances and codes.
C. 
No person, corporation, firm, association, organization, owner or agent shall berth, moor or anchor any houseboat, residential vessel, floating home or other such vessel primarily to be utilized as a residence within Huntington Town waters for the purpose of leasing, renting, selling or servicing such vessels.
A. 
A violation of this article shall be an offense punishable by a fine of not less than five hundred dollars ($500) nor more than two thousand five hundred dollars ($2,500), or by imprisonment for a period not to exceed fifteen (15) days, or both. Each day's continued violation shall constitute a separate additional offense. Any person found by the Bureau of Administrative Adjudication to have violated this article shall likewise be subject to a monetary penalty in an amount within the range of fines authorized herein for any offense or continuing offense.
B. 
In addition to any other remedy provided by law, the Town Attorney may bring an action in the name of the Town in a court of competent jurisdiction for an injunction to enforce this article.
