The Board of Supervisors hereby ordains to enter
into the Articles of Agreement between the Township of Westtown and
the Township of East Goshen in the form proposed by the Township Solicitor
for the purpose of creating the Westtown-East Goshen Police Department
and regulating its operation. Such Articles of Agreement shall be
executed by the Board of Supervisors to enable the Westtown-East Goshen
Police Department to commence operations January 1, 1982.
The Board of Supervisors hereby ordains that
it may execute such amendments to the Articles of Agreement as may
be necessary from time to time to carry out the purposes of this article
and the Articles of Agreement adopted pursuant thereto.

All costs for police service shall be apportioned
in the following manner: East Goshen Township will pay 60% and Westtown
Township will pay 40% of the cost for police protection in the district.
The apportionment shall be reviewed annually by the commission and
adjusted, as necessary, to ensure that the cost to each Township fairly
represents the cost of the police services received by that Township.

A. The commission shall prepare an annual budget which
shall be submitted for consideration and approval to each of the participating
Townships' governing bodies not later than October 15, and, if such
approvals have not been consummated, the prior year's budget shall
be operative until such approval is given to the commission.
B. Each Township shall release to the Treasurer proportionate
shares of the annual budget appropriations quarterly on the first
day of January, April, July and October of each year. The first quarter
shall represent 35% of their obligation, the second quarter 30%, the
third quarter 20% and the fourth quarter 15%.

A. All existing police equipment, materials and supplies
contributed to the Westtown-East Goshen Police Department by the respective
Townships shall remain the property of those Townships upon termination
or dissolution of the joint Police Department.
B. All police equipment, materials and supplies purchased
subsequent to the signing of this agreement shall be equitably distributed
upon the termination of this agreement. In the event that an equitable
distribution is not possible, all or any portion of the equipment,
material and supplies may be sold and the proceeds distributed in
the aforesaid proportion.

This agreement shall have an initial term of
two years. This agreement may be unilaterally terminated by any Township
by giving to the other Township written notice of intention to do
so on or before six months prior to the end of the initial two-year
term or any renewal term. This contract shall automatically renew
itself after the first two-year term for periods of one year and may
only be terminated at the expiration of a one-year period after giving
proper notice in accordance herewith.
