There is hereby adopted by the Board of Supervisors of East Goshen Township for the purpose of enacting and establishing minimum safety standards and regulations for the safe installation and maintenance of certain mechanical equipment situate within the Township, the International Mechanical Code, 2003 Edition, as now and as hereafter supplemented, reissued, amended and revised, as published by the International Code Council, Inc. Not fewer than three copies of the International Mechanical Code, 2003 Edition, have been and now are filed in the office of the Secretary of East Goshen Township, and the same is hereby adopted and incorporated as fully as if set out at length herein.
Ordinance Number 129-C-02 of the Township of East Goshen, titled "The Mechanical Code of East Goshen Township," enacted on January 7, 2002 and codified in Chapter 150 of the East Goshen Township Code, and all other ordinances or parts of ordinances in conflict are hereby repealed.
The following amendments, additions, deletions, and changes are hereby made to the International Mechanical Code, 2003 Edition:
A. 
Section 101.1 shall be amended by the deletion of the words, "[NAME OF JURISDICTION]" and the replacement thereof with "East Goshen Township."
B. 
Section 103 shall be deleted in its entirety and replaced with the following: "103. EAST GOSHEN TOWNSHIP CODE DEPARTMENT."
C. 
Section 103.1 shall be deleted in its entirety and replaced with the following:
103.1 Creation of enforcement agency. The East Goshen Township Code Department (the "Code Department") shall be responsible for administering and enforcing this Code. The Zoning Officer is in charge of the Code Department and for purposes of this Code shall be known as the Code Official.
D. 
Section 103.2 shall be deleted in its entirety and reserved.
E. 
Section 106.5.2 shall be deleted and replaced with the following:

106.5.2. Fees and inspections/reinspections. The Board of Supervisors shall, by resolution, adopt a schedule of fees and a collection procedure which shall be kept on file in the Department of Code Enforcement and revised as necessary by the Board of Supervisors. All such fees shall be paid upon billing by the Township but no later than the 30th day from the date of billing. When the 30th day from the date of billing falls on either a weekend or a holiday on which the Township building is closed, payments that are received before the close of business the next business day immediately following the 30th day shall be deemed to be paid on time and no interest shall be applied. If the fee is not paid within 30 days of the date of billing, the Township shall charge and be entitled to collect interest equal to 3/4 of 1% of the unpaid balance per month, or fraction thereof, until paid.
F. 
Section 106.5.3 shall be deleted in its entirety.
G. 
A new Section 107.5 shall be added which shall read as follows:
107.5. Fee for missed inspections. The Board of Supervisors shall, by resolution, impose a fee to be paid by the permit holder when the permit holder or his or her agent has requested the Township Building Inspector or Code Enforcement Officer to conduct any inspection described in this Section 107 and such Township official is unable to conduct such inspection at the scheduled time due to any delay in completion of the work to be inspected or inability to gain access to the work to be inspected caused by the permit holder or his or her agent.
H. 
Section 108.4 shall be amended to state as follows:
108.4 Violations and penalties. Any person who violates or permits the violation of any provision of this Code or shall fail to comply with any of the requirements thereof or who shall erect, install, alter or repair mechanical work in violation of the approved construction documents or directive of the Code Official or of a permit shall, upon conviction thereof in a summary proceeding brought before a District Justice, be guilty of a summary offense and shall be subject to the payment of a fine of not more than $1,000, plus the costs of prosecution. Upon default of payment thereof, the defendant may be sentenced to imprisonment in the county prison for a period of not more than 30 days. Each section or provision of this Code that is violated shall constitute a separate offense, and each day or portion thereof in which a violation of this Code is found to exist shall constitute a separate offense, each of which violation shall be punishable by a separate fine imposed by the District Justice of not more than $1,000, plus the costs of prosecution, and, upon default of payment thereof, the defendant may be sentenced to imprisonment in the county prison for a term not more than 30 days.
I. 
Section 108.5 is deleted and replaced with the following:
108.5 Stop-work orders. The fine for violation of a stop-work order shall be not less than $200 nor more than $1,000, imposed and collected by the procedure specified in Section 108.4 of this Code.
J. 
Section 109, Means of Appeal, shall be deleted and replaced with the following:

109. MEANS OF APPEAL.
109.1 General. The Township designates the WCACOG Board of Appeals as the Board of Appeals for East Goshen Township who shall hear appeals from decisions of the East Goshen Township Building Code Official which are filed pursuant to the Act and the Township's Building Codes.
