The purpose and objectives of this agreement
are to enable the municipalities and law enforcement agencies to develop
the project, which will address issues of land use and growth management,
environmental management, streets and transportation management, stormwater
and water quality management, sanitary sewer and septic management,
potable water supplies and groundwater management, open space and
recreational planning, permits and property management and other municipal
responsibilities. The Crime/Criminal Regional GIS Project will consist
of a crime mapping/analysis and emergency disaster planning and response
and will enable the participating law enforcement agencies to respond
quickly and efficiently to emergency situations.
West Goshen Township will receive the grant
funds from DCED and will allocate them to the municipalities and law
enforcement agencies in accordance with the allocation set forth in
the Grant Allocation Summary which is attached hereto as Exhibit A. In order to receive the grant funds, the municipalities
and law enforcement agencies shall send a written notice to the Manager
of West Goshen Township specifying the scope of work that has been
completed pursuant to the Grant Allocation Summary and requesting
the amount of grant funds that have been allocated to that specific
item. Upon receipt of written notice from a municipality or law enforcement
agency, the Manager of West Goshen Township may request that each
municipality or law enforcement agency provide additional written
documents that DCED may require to verify that the work for which
the grant funds have been requested has been completed.
The term of this agreement shall be for a period of two years, commencing on the date when this agreement is adopted pursuant to §
33-28 herein, or whenever all grant funds have been allocated and spent, whichever occurs sooner. The parties may agree to renew this agreement if further grant funds are received from DCED by execution of a written addendum. Any of the participating municipalities or law enforcement agencies may terminate their participation in this agreement at any time by further ordinance, resolution or vote by its respective governing body.
The project shall be financed through the grant
funds issued by the DCED and by contributions from the participating
municipalities and law enforcement agencies as shown on the Grant
Allocation Summary.
Any legal fees incurred in the preparation of
this agreement shall be split equally between the municipalities and
law enforcement agencies. If a municipality or law enforcement agency
requires an ordinance to be passed to authorize its governing body
to enter this agreement, each municipality or law enforcement agency
shall be responsible for its own legal fees incurred in the preparation,
advertising and enactment of such ordinance.
This writing embodies the entire agreement between
the parties and may be amended only by a writing signed by all municipalities
and law enforcement agencies.
This agreement shall be construed and enforced
in accordance with the laws of the Commonwealth of Pennsylvania.
This agreement may be executed in any number
of counterparts, all of which shall constitute one agreement.
This agreement shall become effective after
its adoption by the governing bodies of each respective municipality
and upon its due execution by the Chairman and/or President and Secretary
of each municipality on behalf of either the participating municipality
or its respective law enforcement agency, by the Chairperson for the
Westtown-East Goshen Police Commission, and by the District Attorney.
