The Borough Council is hereby authorized and empowered to undertake
within the Borough the control and methods of temporary septic holding tanks
and the associated collection, transportation and disposal of sewage. All
rules and regulations adopted by the Borough shall conform with the provisions
herein, all other ordinances of the Borough and all applicable laws, rules
and regulations of administrative agencies of the Commonwealth of Pennsylvania.
Owners of real estate within the Phase II service area may apply to
the Borough's Sewage Enforcement Officer to install and utilize a temporary
septic holding tank until sanitary sewer service is available.
For purposes of this chapter, a "temporary septic holding tank" means
a watertight receptacle which receives and retains sewage conveyed by a water
carrying system and is designed and constructed to facilitate the ultimate
disposal of the sewage at another site.
Within 30 days after a notice to tap is received from the Economy Borough
Municipal Authority, the temporary septic holding tank must be removed and
connection must be made to the sanitary sewer line at the real estate owner's
expense.
The connection to the sanitary sewer line must be made by a real estate
owner who obtains permission to use a temporary holding tank, regardless of
the distance to the sanitary sewer line and by any means that are necessary.
The Borough's Sewage Enforcement Officer and Building Inspector
are authorized to issue necessary permits for construction in accordance with
this and all other Borough ordinances, codes and regulations.
All real estate owners utilizing a temporary septic holding tank shall:
A. Maintain the temporary septic holding tank in conformance
with this and any other applicable ordinance of the Borough, the provisions
of any applicable law and the rules and regulations of the Borough Council
and any administrative agency of the Commonwealth of Pennsylvania.
B. Permit the Borough or its agents to inspect the temporary
septic holding tank.
C. Deposit with the Borough a bond, issued by a bonding
company that is authorized to do business in Pennsylvania, or establish an
escrow account, in the amount of $5,000 per holding tank. The purpose of the
bond is to insure proper installation, maintenance, disposal and removal of
said temporary septic holding tank and sewage. The bond shall remain in effect
while the temporary septic holding tank is in use and shall contain a provision
that the Borough shall be notified in writing via certified mail from the
bonding company of the termination of said bond at least 30 days prior to
the expiration/termination date.
If a temporary septic holding tank is deemed to be a nuisance or hazard
at any time prior to connection to the sanitary sewer system, it may be ordered
removed at the real estate owner's expense, unless the nuisance or hazard
is immediately remedied.
Temporary septic holding tank permits are valid for up to two years
or until the permittee is required to connect to the sanitary sewer system,
whichever comes first. If for any reason sanitary sewers are not available
to the property within the two-year permit period, Economy Borough will notify
all real estate owners utilizing temporary septic holding tanks. All notified
real estate owners will have 60 days to obtain a system design for the tested
area and submit the same to the Sewage Enforcement Officer for review; obtain
the permit for the on-lot sewage treatment and disposal system; and complete
the installation and successful inspection of such system. This permit will
be issued as part of the original permit application.
Any person who violates any provisions of §
143-8 or §
143-9 shall, upon conviction thereof by summary proceedings, be sentenced to pay a fine of not more than $500, and in default of said fine and costs to undergo imprisonment for a period not in excess of 30 days.
