Individuals owning real estate within the Phase
I Service Area Construction Project may apply to the Borough's Sewage
Enforcement Officer to utilize a temporary septic holding tank until
sanitary sewer service is available.
As used in this Article, the following terms
shall have the meanings indicated:
TEMPORARY SEPTIC HOLDING TANK
A watertight receptacle which receives and retains sewage
conveyed by a water carrying system and is designed and constructed
to facilitate the ultimate disposal of the sewage at another site.
All such rules and regulations adopted by the
Borough shall be in conformity with the provisions herein, all other
ordinances of the Borough and all applicable laws and applicable rules
and regulations of administrative agencies of the Commonwealth of
Pennsylvania.
The collection and transportation of all sewage
from any improved property utilizing a temporary holding tank shall
be done solely by a properly bonded and approved hauling agency, and
the disposal thereof shall be made only at such site or sites as may
be approved by the Department of Environmental Protection of the Commonwealth
of Pennsylvania.
A. The Sewage Enforcement Officer will receive, review
and retain pumping receipts from permitted temporary septic holding
tanks.
B. The Sewage Enforcement Officer shall receive a copy
of the signed hauling contract between the property owner and the
hauling agency with proof of bonding.
The owner of an improved property utilizing
a temporary septic holding tank(s) shall:
A. Maintain the holding tank(s) in conformance with this
chapter or any ordinance of the Borough, the provisions of any applicable
law and the rules and regulations of the Borough Council and any administrative
agency of the Commonwealth of Pennsylvania.
B. Permit only the Borough or its agents to inspect the
temporary septic holding tank(s).
C. Permit only a properly bonded and approved hauling
agency to collect, transport and dispose of the contents therein.
D. Deposit with the Borough a bond, issued by a bonding
company which is authorized to do business in Pennsylvania, in the
amount of $5,000 per holding tank. The purpose of the bond is to insure
proper installation, maintenance, disposal and removal of said holding
tank(s) and sewage. The bond shall be for a period of one year and
shall contain a provision that the Borough shall be notified in writing,
certified mail, by the bonding company of the termination of said
bond at least 30 days prior to the expiration/termination date.
If a temporary septic holding tank is deemed
to be a nuisance or hazard at any time prior to connection to the
sanitary sewer system, it may be ordered removed at the owners expense,
unless the nuisance or hazard is immediately remedied.
Any person who violates any provisions of §
145-29 shall, upon conviction thereof by summary proceedings, be sentenced to pay a fine of not more than $500 and, in default of said fine and costs, to undergo imprisonment for a period not in excess of 30 days.
