[HISTORY: Adopted by the Commissioners of the City of Rehoboth Beach 11-8-1974 as Secs. 11-81 and 11-82 of the 1974 Code. Amendments noted where applicable.]
A. 
No person shall fly or operate any airplane or lighter-than-air craft over the limits of the city at an altitude of less than 1,000 feet.
B. 
Any employee of the city vested with any police powers, upon observing any violations of this section, shall immediately observe the number of any such airplane or craft and shall forward such information to the United States Department of Transportation.
C. 
This section shall not be construed so as to prevent the takeoff or landing of any aircraft within the city.
No person shall land any airplane or lighter-than-air craft upon or along the beach strand between Henlopen Avenue and Penn Street.

A. 
Whenever in this chapter any act or failure to do a required act is prohibited or is made or declared to be unlawful or an offense or a misdemeanor, where no specific penalty is provided therefor, the violation of any such provision of this chapter shall be punished by a fine of not less than $50 nor more than $150, such fine to be in the discretion of the court, and such violator shall pay the costs of prosecution.
B. 
Whenever in this chapter there is no provision for a greater penalty for a second or subsequent conviction for a violation of this chapter, any person who has previously been convicted of the same violation shall be subject to a fine of not less than $75 nor more than $200 for each succeeding offense and shall pay the costs of prosecution.
