The President of the Levy Court of Kent County, Delaware shall appoint
all incumbent and future Code Enforcement Officers I and II and the Division
Head for the Division of Inspections and Enforcement as Code Enforcement Constables.
Code Enforcement Constables so appointed may enforce only those adopted
Kent County ordinances and codes pertaining to building, housing, sanitation
and zoning and shall not have jurisdiction outside the limits of Kent County,
Delaware. Nor shall said Code Enforcement Constables be permitted to carry
firearms while on duty as such.
Appointed Code Enforcement Constables may lawfully issue a summons to
any person he has reasonable ground to believe has committed an offense against
any ordinance or code of Kent County pertaining to building, housing, sanitation
or zoning directing the person to appear before the court having jurisdiction
over such offense whether or not the offense was committed in his presence.
The appointments made under this chapter shall be automatically rescinded
when any of the following conditions occur:
A. Termination of employment with Kent County for any reason.
B. Reclassification of employee to a class specification other than those specified in §
14-1, above.
C. Suspension of employee for those reasons stated in the
Personnel Ordinance of Kent County.
