As used in this chapter, unless the context otherwise indicates, the following terms and words are defined as follows:
ALARM SYSTEM
Any electrical board, control system, device or devices, which a reasonable informed individual of common experience would refer to as a "burglar alarm system" or "police alarm system," that will, upon activation, emit a sound or transmit a signal or message.
ALARM USER
Any person, firm, corporation or other entity using the services of a fire alarm system and/or burglar alarm system and/or police alarm system.
FALSE ALARM
Any activation of an alarm system or its components which does not signal an actual fire or an actual criminal act or its attempt or does not provide evidence for investigative officers to determine if a crime was committed or attempted; also an alarm system activation which indicates a situation other than that which the alarm system was designed to indicate.
PERSON
Includes any individuals, licensees, managers, lessees, partnership, corporations, societies, organizations or other entities.
TELEPHONE NUMBER
Any numbers assigned by a public utility company engaged in the business or providing communications services and facilities to be used by means of a rotary or other system to connect with the Police Department and/or Fire Department of the City of Roseville.
No person shall use or operate, attempt to use or operate or arrange, adjust, program or otherwise install any alarm system that will, upon activation, either mechanically, electronically or by any other automatic means, initiate the intrastate calling, dialing or connection to any telephone number assigned to the Police Department and/or Fire Department of the City of Roseville by a public telephone company.
Any person intending to install an alarm system at any commercial or industrial establishment or private residence that transmits a signal directly to the Police Department or Fire Department shall submit a plan of said system to the Fire Marshal or Chief of Police for the City of Roseville for approval.
Each alarm system user shall maintain a current information card with the Police Department and/or Fire Department, containing the business name, address and telephone number of a person or persons who can render service to the alarm and business premises at any time of the day or night. The registration card may include such other information as the Chief of Police or the Fire Marshal shall find necessary for implementation of this chapter. Each alarm user shall immediately inform the Chief of Police or Fire Marshal of any and all changes in the information on file with the Police Department and Fire Department regarding such registration.
A. 
It shall be unlawful for anyone to activate any alarm system for the purpose of summoning the Police or Fire Department except in the event of a fire or what is reasonably believed to be an unlawful act and/or an unauthorized entry on premises. Whenever an alarm system has been designed and commonly understood to alert others to a fire or the commission of a particular crime, it shall be unlawful for anyone to activate such alarm system for the purpose of summoning the Police or Fire Department, except in the event of what is reasonably believed to be such particular crime or fire.
B. 
It shall be unlawful to install or use an alarm system which, upon activation, emits a sound similar to sirens in use on emergency vehicles or for civil defense purposes.
C. 
The provisions of this section shall not be applicable to audible alarms affixed to motor vehicles.
It shall be unlawful for any alarm user who has or maintains an audible-type alarm system to fail to appear and turn off any such alarm within one hour after being notified by the Police or Fire Department to do so.

The Chief of Police shall cause to have maintained a monthly alarm report in which shall be recorded all of the alarms to which the police have responded.

A. 
[1]Notwithstanding any penalties provided for in the event of a conviction for violation of this chapter and notwithstanding the fact that a prosecution for violation of this chapter has or has not been commenced, in order to defray the cost of responding to false alarms, the owner or lessee of an alarm system described in § 69-1 of this chapter shall be charged for false alarms as indicated in Chapter 133, Fees, where the alarm system is activated and responded to by the Police and/or Fire Department in any of the following cases:
(1) 
No evidence of illegal entry or an attempt thereof.
(2) 
No evidence of fire.
(3) 
A malfunction in the system.
(4) 
Alarm activated by mistake.
(5) 
Alarm activated by persons working on the alarm system, where the Police and/or Fire Department was not previously notified.

B. 
Notwithstanding anything herein to the contrary, no owner or lessee shall be required to pay said costs on the first or second occasion of a false alarm during any one calendar year, but shall be advised, in writing, of said false alarms and of the existence of this chapter. Any costs incurred by the city to respond to third and subsequent occasions of a false alarm during any one calendar year shall be a lien upon the premises and, if not paid by April 1 of the next year following the year in which the costs were incurred, shall be added onto the next city tax statement. Costs shall not be required in the case of any false alarm activated by severe weather or other conditions beyond the control of the owner or lessee of an alarm system.
The City of Roseville shall be under no duty or obligation to any person hereunder by reasons of any provision of this chapter, including any delays in response or failure to respond to any alarm.
Any person violating or neglecting or refusing to comply with any of the provisions of this chapter shall, upon conviction thereof, be punished by imposition of a fine of not less than $100 nor more than provided in Chapter 1, General Provisions, Article I.
