Bicycles — See Ch. 82.
As used in this chapter, the following terms have their meanings set forth in this section:
PARKING STRUCTURE
Any public structure or parking lot designed for the parking of motor vehicles.
PEDESTRIAN
A person on foot, on roller skates or on a skateboard, excluding a person on foot walking a bicycle or moped.
PLAZA
That open space area between the main entrance to a building and the street.
ROLLER SKATES
Any shoe-like device with wheels attached, including but not limited to roller skates, in-line skates or roller blades.
SIDEWALK
That portion of a highway designed or ordinarily used for pedestrian travel.
SKATEBOARD
Any surfboard-like object with wheels attached, including but not limited to vehicles commonly referred to as "scooters," being surfboard-like objects with wheels attached and a handle coming up from the board end of the surfboard area.
Notwithstanding their status as pedestrians, skateboarders and roller skaters operating on sidewalks shall yield the right-of-way to all vehicular traffic and to all other pedestrian traffic upon the sidewalk. Any person roller-skating or riding a skateboard upon a sidewalk or other paved surface intended for use by pedestrians shall not approach, overtake or pass a pedestrian in a reckless or careless manner.
A. 
The City Council may, by resolution, designate locations and times in which skateboards and roller skates may not be operated on sidewalks or other public property. The restrictions contained in any such resolution shall be posted on signs in the area designated by the resolution. No person shall operate a skateboard contrary to the terms of the resolution.
B. 
Skateboarding and roller-skating is expressly prohibited at the following city-owned properties:
(1) 
City Hall Plaza.
(2) 
Library Plaza.
(3) 
Parks and Recreation Plaza.
(4) 
39th District Court and Police Department Plaza.
(5) 
Roseville Eastland Senior Building premises.
(6) 
Roseville Lawn Street Housing Development premises.
(7) 
All Fire Department station plazas.
C. 
Skateboarding and roller-skating shall be prohibited on any surface that deviates from the adjacent sidewalk elevation, including but not limited to ramps, steps, retention walls, handrails, planters, curb or gutter edges, barriers and barricades, benches and picnic tables and monument or sculpture surfaces located on all property owned or operated by the city.
A law enforcement officer apprehending a person for violating this chapter may impound the skateboard. If a person is 18 years of age or older, the skateboard shall be released by the Police Department if the accused appears at the Police Department and provides identification. To obtain release of the skateboard, a person under the age of 18 years of age must appear at the Police Department with a parent or guardian; however, if no such parent or guardian resides in the city, the skateboard may be released if its owner provides a letter from a parent or guardian requesting that it be released. Law enforcement officers shall also have the right to impound as evidence any set of roller skates or a skateboard that is used contrary to this chapter, pending prosecution of such alleged violation of this chapter.
Violation of this chapter is a civil infraction subject to a fine of not more than $25 for the first offense, $50 for the second offense and $100 for the third offense and each offense committed thereafter.
