A. A public utility shall first obtain a permit from the Shade Tree Specialist or other designated person for the trimming or removal of any tree or vegetation located on any street or Borough property. The utility may seek a blanket permit to cover trimming or removal of more than one tree if part of a continuous project as viewed by the Shade Tree Specialist and subject to limitations set forth in Subsection
H of this section.
B. The public utility in seeking to obtain the aforesaid
permit must submit a proposed activity report to the Shade Tree Specialist
or other designated person at least 30 days prior to the scheduled
occurrence along with a permit fee of $50, and the Shade Tree Specialist
or other designated person of the Borough of Eatontown shall review
the proposed activity report for approval. The Shade Tree Specialist
has the right to require a meeting with representatives of the public
utility in order to discuss amendments and revision of the activity
report, to make inquiry concerning elements of the report or to provide
recommendations. A permit shall not be issued until or unless the
report has been approved by the Shade Tree Specialist.
C. All work performed pursuant to permits issued by the
Shade Tree Specialist or other designated person shall be performed
in accordance with current recommendations and approved standards
of the National Arborist Association, American National Standards
Institute (ANSI), ANSI-Z133 and 300A, and the New Jersey Certified
Tree Expert's Board.
D. The Borough supervisory inspection shall be provided
by the Borough Shade Tree Specialist.
E. Periods of emergency.
(1) A public utility may, during periods of emergency
and without first obtaining a permit from the Shade Tree Specialist
or other designated person:
(a)
Install temporary attachments to any tree; and
(b)
Make subsurface emergency repairs.
(2) In such an event, the utility will notify the Shade
Tree Specialist of the Borough of Eatontown of said work within 24
hours of its beginning. The Borough Shade Tree Specialist has the
authority of determining whether a public utility has acted beyond
the scope of the necessary emergency and may refer the matter in such
a case to the appropriate enforcement agency set forth more fully
below.
F. All tree work done while trimming around utility lines
in and along Borough streets shall be by target pruning. All trimming
is to be conducted with consideration for the health of any tree while
allowing for proper electrical line clearance. Any improper work will
void the issued permit and the violator will be subject to a fine
of up to $1,500 for each violation.
G. Every public utility shall ensure that wires and conduits
are fastened and maintained in such a manner as shall prevent damage
to trees, including damage by reason of leakage of gas or other substance
injurious to trees.
H. Information required.
(1) All requests for a permit must be in writing and shall
be accompanied by a statement providing the following information:
(a)
Name, address and telephone number of the person
or entity applying for the permit.
(b)
The proposed work to be performed.
(c)
The date or dates the work will be performed.
(d)
The location of the proposed work.
(2) No permit shall be issued for work that is not done
less than 30 days from the issuance of the permit. The permit shall
include a statement that any tree removal is not permitted unless
the utility mark out is first secured. The Shade Tree Specialist shall
be primarily responsible for the supervision of the aforesaid work.
