For the purpose of this Code and in the interpretation and application of all other ordinances heretofore or hereafter adopted, except as the context may otherwise require, the definitions contained in this section shall apply:
CHARTERThe pertinent provisions of the Optional Municipal Charter Law of the State of New Jersey governing the Mayor-Council Plan F (N.J.S.A. 40:69A-1 et seq.) under which the Township government is constituted.
COUNTYThe County of Passaic, State of New Jersey.
DEPARTMENTAn organizational unit of the government established or designated by ordinance or this Code as a department.
DIRECTORThe head of an administrative department of the Township government.
DIVISIONA basic organizational unit under a Department.
GENERAL LAWAny law or provision of law, not inconsistent with the Optional Municipal Charter Law, heretofore or hereafter enacted which is by its terms applicable or available to all municipalities and the following additional laws whether or not such additional laws are so applicable or available to all municipalities: legislation relating to taxation, local courts, education, health, public authorities serving more than one municipality and municipalities in unsound financial condition.
GOVERNING BODYThe Township Council as constituted by the Township Charter.
LICENSEDLicensed in accordance with the appropriate section or chapter of this Code.
MONTHA calendar month unless otherwise specifically provided.
MUNICIPALITYThe Township of Wayne, County of Passaic, State of New Jersey.
OATHOath shall be construed to include an affirmation where an affirmation may be substituted for an oath. In such cases the words "swear" and "sworn" shall be construed to be equivalent to the words "affirm" and "affirmed."
OCCUPANTAs applied to a building or land shall include any person who occupies the whole or part of a building or land, whether alone or with others.
OFFICER OR OFFICIALAnd the title of an officer or official shall be construed as if the words "of the Township of Wayne" followed it.
ORDINANCEAny act of local legislation heretofore or hereafter adopted, and including this Code, so long as it shall have been adopted by the procedure required for the adoption of an ordinance and so long as it shall remain in force and effect pursuant to law.
OWNERAny part owner, joint owner, tenant in common, tenant in partnership, joint tenant, or tenant by the entirety, of the whole or of a part of a building or land.
PERSONAny natural individual, person, firm, trust, partnership, association, corporation or any other legal entity. Whenever the word "person" is used in any provision of this Code prescribing a penalty or fine, as applied to partnerships or associations, corporation or any other legal entity, the word shall include officers, managers, agents or employees thereof who are responsible for any violations of the provision.
PERSONAL PROPERTYGoods and chattels, rights and credits, monies and effects, evidences of debt, and all written instruments by which any right to, interest in, or lien or encumbrances upon, property or any debt or financial obligation as created, acknowledged, evidenced, transferred, discharged or defeated, in whole or in part, and every thing, except real property as herein defined, which may be subject of ownership.
REAL PROPERTYMeans and includes lands, tenements and hereditaments, all rights thereto and interests therein.
RESOLUTIONMeans and includes any act or regulation of the Governing Body on a matter of special or temporary interest, required to be reduced to writing and which may be finally passed at the meeting at which it is introduced.
SIDEWALKThat portion of a street between the curbline and the adjacent property line which has been paved with concrete or other approved material and is intended for the use of pedestrians.
STATEThe State of New Jersey.
STREETIncludes a street, avenue, road, alley, lane, highway, boulevard, concourse, driveway, culvert, sidewalk and crosswalk, and every class of road, square, place or municipal parking field used by the general public.
TENANT OR OCCUPANTAs applied to a building or land shall include any person who occupies the whole or part of such building or land, whether alone or with others.
TOWNSHIPThe Township of Wayne in the County of Passaic, State of New Jersey.
YEARA calendar year unless otherwise specifically provided.
