The Common Council hereby finds and declares
as a matter of legislative determination, that it is necessary to
the safety, health, life and general welfare of the inhabitants of
the City of Albany that policemen be available in the event of an
emergency, and that such policemen shall be compensated for any such
emergency work that occurs above and beyond their ordinary and regular
workweek.

Pursuant to the authority given by virtue of
the Constitution and the General Municipal Law of the State of New
York, the Common Council does hereby delegate to the Mayor of the
City of Albany, on recommendation of the Chief of Police of the City
of Albany, authority, within the scope and understanding of the General
Municipal Law of the State of New York, to determine when such emergency
exists.

In the event of an emergency, if so determined
by the Mayor of the City of Albany on recommendation of the Chief
of Police of the City of Albany, the City of Albany is hereby authorized
and directed to pay overtime compensation to those policemen who are
called upon to render services in excess of and in addition to their
ordinary and regularly assigned workweek, in an hourly amount equal
to their regular pay per hour.
