It shall be unlawful for any person to place, deposit or permit
to be deposited in any unsanitary manner on public or private property
within the Village of Briarcliff Manor, or in any area under the jurisdiction
of said Village, any human or animal excrement, garbage or other waste.
It shall be unlawful to discharge to any natural
outlet within the Village of Briarcliff Manor, or in any area under
the jurisdiction of said Village, any sewage or other polluted waters,
except where suitable treatment has been provided in accordance with
subsequent provisions of this chapter.
Except as hereinafter provided, it shall be
unlawful to construct or maintain any privy, privy vault, septic tank,
cesspool or other facility intended or used for the disposal of sewage.

A. The owner of any habitable building or property used
for human occupancy, employment, recreation or other purposes situated
within the Village having any property line which lies within 100
feet of an existing accessible public sanitary sewer main shall be
required at said owner's expense to install suitable sanitary facilities
therein and to connect such facilities directly with the public sanitary
sewer in accordance with the provisions of this chapter and the regulations
of the Village of Briarcliff Manor, where the following circumstances
exist:
(1) The building is a newly constructed residential dwelling,
the building permit for which was issued after the effective date
of this section; or
(2) An existing septic system serving the building or
property has failed or is otherwise in need of any of the following
repairs, as determined by the Building Inspector:
(a)
Replacement of the septic tank;
(b)
Replacement of 50% or more of the existing septic
field; or
(c)
Expansion of the existing septic field by 50%
or more.
B. Nothing in this section shall be deemed to supersede
the authority of the Westchester County Department of Health in enforcing
the Sanitary Code of the County of Westchester.
