The Town Board is desirous of providing a mandate
to the Planning Board to refer all subdivision applications to the
Conservation Advisory Council and to the Parks, Recreation and Conservation
Advisory Council for their review and comments with respect to the
appropriateness of accepting recreation and/or money in lieu of said
land on any subdivision application. It is for this purpose that this
article is hereby considered adopted by the Town Board.
The policies and standards for reserving recreational areas or money in lieu thereof in major subdivisions, as set forth in Chapter
265, Subdivision of Land, §
265-11 of the Town Code of the Town of Cortlandt, is hereby supplemented by this article.
The Planning Board or, by resolution adopted
by the Planning Board so authorizing him, the Director of Planning
shall, upon receipt of any application for a major subdivision in
the Town, refer said application and a copy of the proposed subdivision
map to the Conservation Advisory Council and the Advisory Board for
Parks, Recreation and Conservation. Said Boards shall then have 30
days from the time of referral to place, in writing, their comments
to the Planning Board concerning their recommendations with respect
to whether or not the Planning Board should accept land or money in
lieu of land to satisfy the recreation requirements of law.
Following the expiration of 30 days from the
date hereof, the Planning Board is free to act without waiting for
any written comments from either of the two Boards mentioned herein.
This article shall not be interpreted in any
way so as to impede the authority of deciding whether or not the reservation
of land or money in lieu thereof should be made with respect to any
subdivision in the Town of Cortlandt. It shall be the sole and exclusive
domain of the Planning Board of the Town to determine whether or not
recreation land should be reserved or money in lieu of land should
be accepted on any subdivision in the Town.
