GENERAL REFERENCES

The purpose of this chapter shall be to improve and promote the health, safety and general welfare of the community by establishing traffic regulations within parking areas, apartment complexes, supermarkets and any other private property devoted to public use and access. The Village Board of Trustees finds that improper parking on certain private properties open to the public may impede the accessibility of fire apparatus in fighting any potential fires on private property. The purpose of this chapter is to keep fire lanes open so as to make private property accessible to Fire Department and emergency service vehicles.
As used in this chapter, the following words shall have the following meanings:
FIRE INSPECTOR
The Village of Mamaroneck Fire Inspector or his designated representative.
FIRE LANE
A passageway or roadway, with a minimum width of 10 feet, along which Fire Department equipment, fire-fighting apparatus and emergency service vehicles may gain access to private property to fight fires and/or give aid.
OBSTRUCTION
The prevention or hindrance of free movement along or over a fire lane through some means other than a parked vehicle.
PARK
The standing or halting of a vehicle, whether occupied or not, other than temporarily for the purpose of, and while actually engaged in, loading or unloading.
PERSON
Every natural person, firm, copartnership, association or corporation.
SIAMESE
Fire Department connection, either freestanding or directly attached to a structure.
STANDPIPE
Fire Department connection, either freestanding or directly attached to a structure.
VEHICLE
Every device in, upon or by which any person or property is or may be transported or carried.
Fire lanes and standpipe and siamese locations shall be established and designated by resolution of the Village Board of Trustees, pursuant to such specifications as may be given by the Village Fire Inspector. The Village Fire Inspector shall weigh all factors as to the advisability of fire lanes, including but not limited to facts and circumstances disclosed in communications with landowners.
Notwithstanding and not in limitation of any other provision thereof, no automobile, truck or other motor vehicle and no physical object or material of any nature, shall be parked, placed or permitted to remain for any length of time whatever within a clearance of three feet in any direction from the fire standpipe and sprinkler siamese connections. A clearance of three feet shall be maintained at all times to allow the Fire Department serving the affected area of the Village of Mamaroneck adequate access to the same.
For the purpose of maintaining an accurate record of fire lanes designated and established under the provisions of this chapter, there is hereby established a system of schedules set forth in § 183-11 of this chapter, in which shall be entered a description of all fire lanes adopted.
Signs shall be installed, together with other markings as may be deemed necessary and proper by the Fire Inspector, to mark and designate fire lanes and in accord with applicable standards of the New York State Manual of Uniform Traffic Control Devices. Said signs and markings shall be installed by and at the expense of the owner of the property within 30 calendar days after receipt of official notice by the Fire Inspector designating and depicting areas and locations of such signs and markings. In the event that any owner refuses or fails to install any and all required signs and markings within the thirty-day period following receipt of said official notice, the Village of Mamaroneck Traffic Sign Department shall promptly perform the required work, and the Village Board may provide for the assessment of all costs and expenses so incurred by the Village in connection with any action taken as above, to become a lien against the land on which such signs and markings are located.
No person shall park a vehicle within any area designated and established as a fire lane. Any person violating this provision shall, upon conviction, be punished by a minimum fine of $25 for the first offense; for the second offense within one year, by a fine of $50; and for any subsequent offense within one year from the date of the first offense, by a fine pursuant to the penalties as imposed by the New York State Uniform Fire Prevention and Building Code. The Police Department shall have authority to have any vehicle parked in violation of this chapter towed or otherwise removed at the expense of the owner of the vehicle.
No person shall obstruct a fire lane. Every person violating this provision shall, upon conviction, be punished by a fine not to exceed $250 or by imprisonment for a term not exceeding 15 days, or by both such fine and imprisonment. The Village of Mamaroneck may also institute any appropriate actions or proceedings to prevent such obstruction, to restrain and to correct or abate such violation and/or to remove the same.
The parking, placing, stopping or standing of any motor vehicle or any other object or material within any area designated as a fire lane shall be a violation of this chapter. It shall be the duty of the Police Department of the Village of Mamaroneck and/or the Village's duly appointed Fire Inspector to inspect and enforce fire lanes and to see that the lanes are maintained free from obstruction. In addition to the penalties set forth in §§ 183-7 and 183-8 of this chapter, the Police Department, or such public agency or private person, firm or corporation as may be designated by them, shall have the authority to have any motor vehicle, object or material in violation of this chapter towed or otherwise removed at the owner's expense.
Any police officer, parking enforcement officer or Fire Inspector of the Village of Mamaroneck shall issue a summons for the violation of this chapter to the owner or any person operating or controlling any automobile, truck, motor vehicle, object or material parked or placed within any restricted fire lane as hereby designated. Whenever any other violation of any of the provisions of this chapter is found to exist, it shall be reported by the Fire Chief of the Fire Department serving the affected area of the Village of Mamaroneck to the Fire Inspector of the Village of Mamaroneck, who shall then issue an order directed to the owner or occupant of the premises affected to remove any dangerous materials or remedy any other hazardous conditions as he may direct, within 24 hours, and, upon the failure or refusal of the person to whom such order is directed duly to comply therewith upon the complaint of the Fire Chief of the Fire Department serving the affected area of the Village of Mamaroneck, a summons shall be issued to such person for such violation.
In accordance with the provisions of § 183-3, the following areas, as shown on maps on file in the Fire Inspector's office, are designated as fire lanes:

School building at 145 New Street: The roadway on New Street in front of the building from Ralph Avenue to Monsignor Goodwine Avenue (formerly Underhill Avenue)
Apartment building at 501 North Barry Avenue: The roadway in front and adjacent to the entire length of the building facing North Barry Avenue
Building at 1100 East Boston Post Road: The roadway in front and adjacent to the entire length of the building
School building at 1310 Harrison Avenue: The driveway from Harrison Avenue to the rear of the building, which is located on the east side of the school building
Professional building at 1600 Harrison Avenue: The roadway of the circular driveway located in front of the building
Mamaroneck Beach, Cabana & Yacht Club, Foot of South Barry Avenue: The roadways of the driveways adjacent to the front and the side of the main building (except three spaces as noted on the map on file in the Fire Inspector's office)
Rye Neck School Building at 310 Hornridge Road: All driveways around entire building, including driveway to gym
Apartment building at 300 Livingston Avenue: The roadway adjacent to the part of the building that fronts the dead end of Cortlandt Avenue
Beach Point Club, Rushmore Avenue: The roadway of the circular driveway adjacent to the part of the building facing Mamaroneck Harbor and the roadway adjacent to the building facing Rushmore Avenue, encompassing the area from the delivery driveway to and including the driveway on the east side of the building
Orienta Beach Club, 1054 Walton Avenue: The roadway of the semicircular driveway adjacent to the front of the building from the south side of the building to the delivery driveway on the north side of the building
School building at 856 Orienta Avenue: The roadway of the circular driveway adjacent to the front of the building
Westchester Jewish Center, Corner of Rockland Avenue and Palmer Avenue: The upper driveway curbline closest to building structure

Each separate provision of this chapter shall be deemed independent of all other provisions herein, and if any provision shall be declared invalid, all other provisions hereof shall remain valid and enforceable.
