GENERAL REFERENCES
Vehicles and traffic — See Ch. 156.
Whenever in this chapter the following terms are used, they shall have the meanings respectively ascribed to them in this section, as well as those meanings which are commonly understood.
AUTHORIZED VILLAGE EMPLOYEES
Such person or persons employed by the Village of Ocean Beach or performing work for the Village of Ocean Beach as are so designated as "authorized Village employees" by the Mayor.
BICYCLE
Includes a vehicle with two tandem wheels with solid or pneumatic tires, having a steering bar or wheel, with only one seat intended for one passenger at a time and propelled by pedals. Excludes twin or multiple-passenger vehicles.

MOTORCYCLE
A two-wheeled automotive vehicle having one or two saddles.
MOTOR SCOOTER/MOPED
A wheeled motorized vehicle or scooter, either with or without a seat, including self-balancing motorized scooters.

OFF SEASON
5:00 a.m. on the Tuesday after Labor Day through and including 7:00 p.m. on the Friday of the weekend before the July 4th holiday.

OPERATE
Refers to the use, putting into action or causing to function any of the vehicles or objects or contrivances herein defined.
ROLLERSKATES/BLADES
Shoes with a set of wheels attached or a frame with wheels attached that can be fitted to the sole of a shoe, including rollerblades and inline skates.

SCOOTER
A foot-operated vehicle consisting of a narrow board mounted between two wheels in tandem with an upright steering handle.
SKATEBOARD
A narrow board mounted on roller-skate-type wheels.
SUMMER SEASON
7:00 p.m. on the Friday of the weekend before the July 4th holiday through and including 5:00 a.m. on the Tuesday after Labor Day.

TRAINING WHEELS
Wheels used for balancing or teaching bicycle riding, the use of which shall still render a bicycle a bicycle for the purpose of this chapter despite now having four wheels instead of two wheels.

TRICYCLE
Includes a three-wheeled vehicle propelled by pedals.

No motorcycle, motor scooter, moped or like vehicle shall be operated on any of the public walks or in any public places within the Village of Ocean Beach, except by on-duty Police or Fire Department personnel.

A. 
Summer season.

(1) 
No person over the age of 12 years may operate or use a skateboard, roller skates/blades or a scooter on any of the public walks or in any public places within the Village of Ocean Beach during the summer season.
(2) 
Permitted persons (12 years of younger) may only operate or use a skateboard, roller skates/blades or a scooter on any of the public walks or in any public places within the Village of Ocean Beach during the summer season between the hours of 5:00 a.m. and 7:00 p.m. on Monday through Thursday, and between the hours of 5:00 a.m. and 4:00 p.m. on Fridays.
(3) 
The operation or use of a skateboard, roller skates/blades or a scooter on any of the public walks or in any public places within the Village of Ocean Beach during the summer season is prohibited on Saturdays, Sundays and holidays.
B. 
Off season. Persons may only operate or use a skateboard, roller skates/blades or a scooter on any of the public walks or in any public places within the Village of Ocean Beach during the off season between sunrise and sunset.

C. 
Restricted areas. No person may operate or use a skateboard, roller skates/blades or a scooter at any time on Bay Walk, Delivery Lane, on the tennis courts or on any public walk or in any public place north of Bay Walk within the Village of Ocean Beach.

D. 
All persons using a skateboard, rollerskates/blades or a scooter as permitted in this section within the Village of Ocean Beach are required to wear a protective helmet.
E. 
No person shall operate or use a skateboard, rollerskates/blades or a scooter at any time except in a safe and prudent manner.

A. 
No person may operate or use a bicycle, tricycle or like vehicle on any of the public walks or in any public places within the Village of Ocean Beach, except as permitted herein.
(1) 
During the off season, as defined herein: Unless otherwise restricted below, riding is permitted within the Village at all times.
(2) 
During the summer season, as defined herein:
(a) 
No riding is allowed at any time on Bayview Walk between Ocean Road and Surf View Walk.
(b) 
No riding is allowed at any time north of Bayview Walk.
(c) 
No riding from Friday, 7:00 p.m. through Sunday, 7:00 p.m.
(3) 
In addition, during the following holiday observances, the restrictions are as follows:
(a) 
Memorial Day weekend: no riding from Friday, 7:00 p.m., through Tuesday, 5:00 a.m.
(b) 
Fourth of July weekend:

No riding from at least July 3, 7:00 p.m., through July 5, 5:00 a.m.
[2] 
All other summer season restrictions listed above apply.
(c) 
Labor Day weekend: no riding from Friday, 7:00 p.m., through Tuesday, 5:00 a.m.
B. 
A permit shall be issued by the Board or an individual or individuals designated by the Board to the following persons for essential or emergency services only:
(1) 
Any on-duty police officer or code enforcement officer of the Village of Ocean Beach or the County of Suffolk or the State of New York or the federal government.
(2) 
A duly licensed medical doctor who maintains an office for the practice of medicine in the Village of Ocean Beach.
(3) 
Active fire fighters who are members in good standing of the Fire Department of the Village of Ocean Beach, excluding Bay Walk, unless responding to a fire or emergency.
(4) 
Any Village official for use on official business.
(5) 
Such other persons for whom the issuance of a permit, whether temporary or permanent, is deemed by the Mayor and/or the Village Administrator and/or the Village Board and/or the Chief of Police to be appropriate under the circumstances.

C. 
A permit may be issued by the Board or an individual designated by the Board upon good cause shown after the operator shall first obtain a certificate from a physician certifying the serious medical need of such operator to use such a bicycle or tricycle for transportation. The grant of permission by the Board or its designee shall be valid for a period not to exceed one season.
D. 
Subject to and in addition to all requirements and restrictions contained in this chapter, all persons who operate or use a bicycle, tricycle or like vehicle on any public walk or in any public place within the Village of Ocean Beach shall:

(1) 
Yield the right-of-way to pedestrians and emergency vehicles;
(2) 
Operate in a safe and prudent manner and at a safe and prudent speed;
(3) 
Only operate a bicycle, tricycle or like vehicle that has an overall width of less than 31 inches; and
(4) 
Yield the right-of-way to all traffic, vehicular or otherwise, traveling westbound or eastbound on Ocean View Walk and Midway Walk.
E. 
The provisions of § 56-5C of this chapter shall also be applicable to persons under the age of 12 years; however, no penalty for the offense shall be assessed; however, enforcement shall be permitted.

No bicycle or tricycle otherwise permitted to be operated pursuant to the provisions of this chapter shall be operated between sunset and sunrise without having a properly lighted headlight attached to the front of the vehicle, visible under normal atmospheric conditions from the front end for a distance of not less than 300 feet nor without a red light or a reflector attached to the rear of the vehicle visible for a distance of not less than 200 feet from the rear of the bicycle or tricycle when light is shone upon it. No bicycle or tricycle otherwise permitted to be operated pursuant to the provisions of this chapter shall be operated at any time faster than is reasonable and proper, and pedestrians shall at all times have the right-of-way, except in the case of an active fireman proceeding to a fire. No bicycle or tricycle shall be operated at any time without having a properly functioning horn, bell or other mechanical warning device. Operation by persons 14 years and under shall require said person to wear an approved helmet. Passengers five years and younger are required to wear helmets. Operators shall additionally be liable for the failure of passengers to wear helmets as may be required herein.

Any bicycle operated within the Village of Ocean Beach may be inspected, registered and licensed by the Ocean Beach Police Department, and such license shall be effective for the life of the bicycle. Such license shall not be transferable. A schedule of inspection, registration and licensing standards shall be established by the Board of Trustees.

The Board of Trustees may, by regulation enacted from time to time, establish an annual fee to be charged for the issuance of any permit which may be issued hereunder.

Any person, firm or corporation violating the provisions of this chapter shall be deemed a disorderly person in violation of this chapter, which shall constitute disorderly conduct; and such person shall be punishable, upon conviction thereof, by a fine of at least $25 and not exceeding $500 for each offense.

The Board of Trustees may revoke any permit issued hereunder for any person, firm or corporation adjudged to be in violation of the provisions of this chapter or of any of the special conditions pursuant to which the permit was issued. Such revocation may be in addition to any fine imposed under § 56-9 hereof.
