The following definitions shall be applicable to this article:
ESTABLISHMENT
Any place of business in which goods or merchandise is sold or offered for sale to a purchaser.
RETAIL
The sale or the offer for sale of goods or merchandise on a direct basis to a purchaser.
SPECIAL SALE
A group endeavor sponsored by the Chamber of Commerce or other organization acting on behalf of a group of retail establishments for a promotional sale or for a sale for a particular purpose; such sales to be conducted over a limited period of time not to exceed three days for any one sale.
A. 
It shall be unlawful for any retail establishment, except those set forth in § 138-10 hereof, to operate and remain open to the public between the hours of 11:00 p.m. and 6:00 a.m.; provided, however, that a permit may be issued by the Board of Trustees for the conduct of a special sale on such terms and conditions as may be approved by the Board of Trustees.
B. 
An application for such permit must be made at least 30 days before the beginning of such special sale and must contain information as to:
(1) 
The times when such sale shall take place.
(2) 
The hours during which the retail establishments are to remain open.
(3) 
The area included in such sale.
(4) 
The purpose of such sale.
(5) 
The approximate number of retail establishments participating in such sale.
This article shall not apply to restaurants, ice-cream parlors, bars and grills, billiard parlors, gasoline stations, drugstores and bowling alleys.
