The Town of Shelter Island is unique, completely
surrounded by water and located between the North and South Forks
of Long Island, Suffolk County, New York, having an economy heavily
dependent upon seasonal tourist trade, producing great fluctuations
in the size of population throughout the year. It is the intent of
this legislation to exercise the powers conferred by the New York
Municipal Home Rule Law § 10, Subdivision 1d, and to supersede
the New York Town Law § 158, Subdivision 2, insofar as it
limits the number and hours of special policemen employed by the Town
of Shelter Island.
The Shelter Island Town Board may employ special
policemen in accordance with the New York Town Law § 158,
Subdivision 2, but in a number up to 10 and without restriction as
to hours and days of employment.

This article is adopted as a local law pursuant to the authority conferred in Article
IX of the New York State Constitution, Article 2, § 10, of the New York Municipal Home Rule Law, and Article 4 of the New York Town Law.
Provisions of this article shall supersede New York Town Law,
insofar as they are inconsistent with such article.
Should any section or provision of this article be decided by
the courts to be unconstitutional or invalid, such decision shall
not affect the validity of the article as a whole or any part thereof
other than the part so decided to be unconstitutional or invalid.
Solely for the purpose of management, storage and dissemination
of police records, including response to FOIL requests, the Chief
of Police shall serve as records' officer for the Shelter Island
Town Police Department.
Records shall be maintained for a period of one year unless
a longer period is proscribed by law, labor agreement, or police department
policy, rules and procedures.
