This chapter shall be known as the "Antitrespass Ordinance of the Town
of Shelter Island."
No person, not being the owner thereof or a peace or public
officer actually engaged in discharging duties in connection with his office,
shall drive or park any automobile, wagon or other conveyance nor enter upon,
cross or make any use whatsoever of any private property within the Town of
Shelter Island, excluding the Village of Dering Harbor, without the written
consent of the owners of such lands.
Nothing herein contained, however, shall be construed to restrict any
public right in or to any beach or strand or park, provided that access to
such beach or strand is had from a public road or public lands.
A person who intrudes upon any lot or piece of land within the bounds
of the Town of Shelter Island, exclusive of the Incorporated Village of Dering
Harbor, except public property specifically designated for use by the public,
without the aforementioned authority from the owner thereof, is guilty of
an offense punishable by a fine of not more than $250 or imprisonment for
not more than 15 days, or by both such fine and imprisonment. Each separate
violation shall constitute a separate offense.
