No owner or operator of any motor vehicle or any other vehicle shall park such vehicle Monday through Friday between the hours of 9:00 a.m. and 6:00 p.m. and Saturdays between 9:00 a.m. and 9:00 p.m., except Sundays and holidays, for more than a period of time authorized and noted on each parking meter at any one time upon the portions of the streets upon which meters shall be placed, and unless the appropriate and required deposit of coins shall have been made in each such case.

Article IV of Chapter 175 of the Code of Evans City Borough, pertaining to parking meter requirements, shall not apply during the winter holiday (Christmas) season. The “winter holiday (Christmas) season” shall be defined as beginning on the third Saturday of December at 12:01 a.m. and ending on the first Saturday in January at 11:59 p.m.
On specified streets, the proper Borough officers shall space and erect parking meters, approximately 20 feet apart, which, upon the deposit of a coin and the manual turning of a handle, as hereinafter provided, will indicate the duration of the legal parking period and the time when such period has elapsed.
A.
The owner or operator of a vehicle shall, upon entering the parking space or zone during the time of limited parking, immediately deposit an appropriate and required coin of the United States in the parking meter alongside of or next to the parking space and operate the meter in accordance with the instructions thereon, and failing to do so shall constitute a violation of this section. Each deposit of a coin will permit the vehicle to be parked for the period designated by the instructions on that particular meter.
B.
Rates. The Borough Council shall adopt by resolution, from time to time, a rate schedule governing the coins to be deposited and the time permitted for such coins in the various parking meters within the Borough.

No person shall park any vehicle beyond the space designated by a parking meter or park a vehicle in any way so that the same shall not be wholly within the parking space as designated by the parking meters.
No person shall deposit or cause to be deposited in any parking meter a slug, device or metallic substitute for coins of the United States.
The fact that the coin was inserted in the appropriate slot and the handle was not properly turned shall not be a defense against a violation under this article.
No person shall deface, tamper with, damage, open or willfully break, destroy or impair the usefulness of any parking meter installed under the terms of this article.
Nothing contained in this article or any ordinance hereafter establishing parking meter zones shall be construed to permit the parking of vehicles in those spaces within any zone in which, by other ordinances of the Borough, parking is prohibited. Until meters are actually installed in the parking zones hereinbefore described, the parking of cars in such zones or that part of the zone in which parking meters are installed shall be limited to the period or periods of time as fixed by other ordinances of the Borough.

A.
Whoever violates any provision of this article for which no other penalty is provided shall be fined a parking ticket fine in an amount established from time to time by resolution of Borough Council, if paid within 48 hours of the time and date noted on the ticket, the same to be placed in boxes provided on certain of the parking meter posts or paid at the Borough office; or a fine in an amount established from time to time by resolution of Borough Council, if paid after such forty-eight-hour period but prior to 30 days after the offense. After 30 days, the fine for violation shall not be less than an amount established from time to time by resolution of Borough Council, plus costs of prosecution, including reasonable attorney’s fees and costs, and in default thereof, the violator shall undergo imprisonment in the Butler County Jail for not less than one day nor more than 30 days. At the expiration of 48 hours after the offense, if the fine has not been paid, the Borough may elect to send a courtesy notification by regular first-class mail to the owner of the offending vehicle as listed in the motor vehicle registration records of the state of the vehicle’s licensure. Failure of the Borough to send such notification shall not be a defense to the adjudication of the violation of any offense provided for in this article but may be considered by the District Justice as a mitigating factor in the determination of the fine thereof. B.
Whoever violates § 175-27 or 175-29 shall be fined an amount established from time to time by resolution of Borough Council (see Appendix § A200-2), together with costs of prosecution, including reasonable attorney’s fees and costs, and in default thereof shall undergo imprisonment in the Butler County Jail for not less than five days nor more than 30 days.
