This chapter shall be known and may be cited as "The North Codorus Township Subdivision and Land Development Ordinance."
This chapter has been adopted by the North Codorus Township Board of Supervisors to:
A. 
Provide for the harmonious development of the Township by assisting in the equitable and efficient integration of all subdivision and land developments;
B. 
Ensure conformance with the Township's Comprehensive Plan; Floodplain Management Ordinance, Chapter 102; Stormwater Management Ordinance, Chapter 158; and Zoning Ordinance, Chapter 195;
C. 
Provide for the general welfare, health and safety of the residents of the Township by providing and protecting natural and cultural features, recreation, conservation, and other open spaces;
D. 
Ensure the availability of adequate public facilities including roadways, walkways, water supply, sanitary sewerage facilities, and stormwater management facilities;
E. 
Facilitate the safe and effective movement of traffic;
F. 
Provide for the proper distribution of population; and
G. 
Serve such other purposes as are authorized for a SALDO by the PA. MPC.
The Township Planning Commission and designated Township staff are hereby designated by the Township Board of Supervisors as the agency and persons which shall review and make recommendations on all preliminary and final plans as required herein. The Board of Supervisors shall have authority to act on all preliminary and final plans as required herein for the Township of North Codorus.
A. 
No subdivision or land development of any lot, tract, or parcel of land located in North Codorus Township shall be effected, and no street, sanitary sewer, storm sewer, water main, or other improvements in connection therewith shall be laid out, constructed, opened or dedicated for public use or travel, or for the common use of occupants of buildings abutting thereon, unless and until a final subdivision plan has been approved by the Township Board of Supervisors and publicly recorded in the manner prescribed herein; nor otherwise, except in strict accordance with the provisions of this chapter.
B. 
No lot in a subdivision may be sold; no permit to erect or alter any building upon land in a subdivision or land development may be issued; and no building may be erected or altered in a subdivision or land development, unless and until a final subdivision plan or land development plan has been approved by the Township Board of Supervisors and recorded, and until construction of the improvements required in connection therewith has been guaranteed in the manner prescribed herein.
C. 
This chapter shall apply to all subdivision and land development plans submitted after the effective date of this chapter and to all subdivision and land development plans submitted before the effective date of this chapter which no longer have protection from the effect of changes in governing ordinances granted by § 508(4) of the MPC.
D. 
Changes to Township ordinances after a preliminary plan is submitted and/or is approved. See § 508(4) of the MPC.
E. 
MPC amendments. Where a provision of this chapter quotes a provision of the MPC, and the MPC is subsequently amended, the amended provision of the MPC shall apply.
F. 
All subdivision and land development plans are subject to the prevailing Zoning Ordinance[1] and all other applicable ordinances, regulations, and requirements of the Township.

It is hereby declared to be the legislative intent that if a court of competent jurisdiction declares any provisions of this chapter to be invalid or ineffective in whole or in part, the effect of such decision shall be limited to those provisions which are expressly stated in the decision to be invalid or ineffective, and all other provisions of this chapter shall continue to be separately and fully effective. The Board of Supervisors hereby declares that it would have passed this chapter and each section or part thereof, other than any part declared invalid, if it had advance knowledge that any part would be declared invalid. If the entire SALDO would be declared invalid, then the North Codorus Township SALDO that was in effect immediately prior to the enactment of this new SALDO shall automatically be reinstated as the SALDO for North Codorus Township.
The preexisting North Codorus Township SALDO, as amended, is hereby repealed, in addition to the repeal of any other Township ordinances or resolutions or parts thereof that were adopted prior to this chapter that are clearly in direct conflict with this chapter.
Under the authority conferred by the Pennsylvania Municipalities Planning Code, as amended, the Board of Supervisors of North Codorus Township hereby enacts and ordains into an ordinance the attached document this 17th day of February, 2015. This chapter shall become effective in five calendar days.
