Village of Shorewood, WI Article VIII Parking Limits and Regulations

§ 500-14 General parking restrictions.

A. No person shall stop or leave any vehicle standing in any of the following places, except an emergency vehicle or, in the case of any other vehicle, temporarily, for the purpose of and while actually engaged in loading or in receiving or discharging passengers and while the vehicle is attended by a licensed operator so that it may be promptly moved in case of an emergency or to avoid obstruction of traffic:

(1) In a loading zone.

(2) In an alley in a business or residential district.

(3) Within 10 feet of a fire hydrant unless a greater distance is indicated by an official traffic sign.

(4) Within four feet of the entrance to an alley or a private road or driveway, unless a greater distance is indicated by an official traffic sign.

(5) Closer than 15 feet to the near limits of a crosswalk.

(6) Between the sidewalk and the curb of a public street.

(7) Between or adjacent to any public building in such manner as to block fire exits or emergency vehicle or emergency personnel access to such building.

(8) Upon any portion of a highway where and at the time when parking is prohibited, limited or restricted by official traffic signs.

B. There shall be no parking by any vehicle except a legally licensed bus or emergency vehicle in a bus loading zone.

C. There shall be no parking by any vehicle except a legally licensed taxicab or emergency vehicle in a taxicab stand.

D. As identified in § 500-14A, there shall be no parking by any unregistered motor vehicle, as prohibited by Wisconsin Statutes, § 341.65(2).

(1) "Unregistered motor vehicle" means any motor vehicle that is located upon any alley, street, highway, public way, or thoroughfare and that is not displaying valid registration plates, a temporary operation plate, or other evidence of registration as provided under § 341.65(1)(b), Wis. Stats., for the vehicle's current registration period or for a registration period for the vehicle that expired within the immediately preceding 31 days.

E. As identified in § 500-14A, there shall be no parking by any vehicle where the vehicle identification number (VIN) has been made impossible to read, removed, altered, or obliterated.

(1) "Identification number" means the numbers, letters or combination of numbers and letters assigned by the manufacturer of a vehicle or vehicle part or by the Wisconsin Department of Transportation and stamped upon or affixed to a vehicle or vehicle part for the purpose of identification. This term does not include the letters, numbers, or combination thereof on vehicle license plates.

F. As identified in § 500-14A, there shall be no parking by any vehicle with excessive parking citations.

(1) "Excessive parking citations" means any illegally parked motor vehicle that is located upon any alley, street, highway, public place, or thoroughfare that has three or more unpaid parking citations in excess of 60 days in violation of Shorewood Village Ordinance §§ 500-14 through 500-31.

§ 500-15 Vending from parked vehicles.

There shall be no parking on any street or portion thereof by any vehicle from which the operator, or owner, is engaged in vending goods, wares or merchandise.

§ 500-16 Night parking.

A. Restrictions.

(1) No vehicle shall be permitted to stand in one place on a Village street or highway for more than 24 hours.

(2) Between the hours of 12:00 a.m. and 5:00 a.m., no person shall park on any Village street or highway motortrucks, truck tractors, semitrailers, or vehicles exceeding 6,000 pounds gross weight. This prohibition does not apply to:

(a) Vehicles including trucks, trailers, or power units upon or in reasonable proximity to construction sites during which periods of time they may be in use; and

(b) Trucks permitted under § 500-16B(2).

(3) Except as otherwise restricted or permitted under the Shorewood Village Code, no person shall park any other vehicle not listed in § 500-16A(2) on any Village street or highway between the hours of 2:00 a.m. and 5:00 a.m. on any day except Saturdays, Sundays or holidays.

B. On-street overnight parking permit.

(1) Vehicles may be parked during the hours between 2:00 a.m. and 5:00 a.m., provided that they shall first obtain an on-street overnight parking permit from the Village after filing an application and paying a permit fee, all as required under this section, and shall be parked as authorized by such permit, as provided in Subsection E.

(2) The owner of any motortruck with valid license plates issued by the Wisconsin Department of Transportation, Division of Motor Vehicles, but not used for commercial purposes, and which is not larger than 21 feet in length, seven feet in width, and seven feet in height, and which has no more than two single-tired wheels on the front axle and no more than two single-tired or doubled-tired wheels on the rear axle, shall be eligible to purchase an on-street overnight parking permit for said vehicle as provided in this section.

(3) Any vehicle for which a person is applying for an on-street overnight parking permit may be inspected for purposes of determining eligibility for the permit as provided in this section.

(4) Vehicles that obtain an on-street overnight parking permit must also display, while parked, valid motor vehicle license plates.

C. Alternate-side parking.

(1) Vehicles parked on North Oakland Avenue or East Capitol Drive east of North Oakland Avenue pursuant to this section authorizing night parking shall be parked:

(a) On the oddly addressed side of the street between the hours of 2:00 a.m. and 5:00 a.m. on odd days of the calendar; and

(b) On the evenly addressed side of the street between the hours of 2:00 a.m. and 5:00 a.m. on even days of the calendar.

(2) Exceptions to alternate-side parking. Alternate-side parking restrictions shall not apply to the street sections with insufficient width where parking is only designated on one side of the street.

D. Certain vehicles not eligible. Motortrucks, except as provided elsewhere in this chapter, luxury limousines, motor buses, motor delivery wagons, trailers, semitrailers, camping trailers, motor homes, mobile homes and tractors shall not be eligible for on-street overnight parking permits.

E. Application and permit.

(1) Application listing. The application listing shall contain the name and address of the permit applicant, the license number and state of issuance of valid motor vehicle license plates, the expiration date of the permit applied for and any other reasonable and pertinent information the Village may from time to time require. A statement shall be included in the application that the vehicle for which the application is made does not violate Subsections B(2) and D.

(2) Permits. The permits shall contain the expiration date.[1]

F. Exceptions.

(1) Holidays. Except as provided in Subsection C of this subsection relating to alternate-side parking and Article XII of this chapter relating to parking during snow emergencies, this section shall not be effective and in force on the following: on the morning of, and the morning following, the first day of January, New Year's Day; last Monday in May, Memorial Day; July 4, Independence Day; first Monday in September, Labor Day; fourth Thursday in November, Thanksgiving Day; and December 25, Christmas Day.

(2) Emergencies. This section shall not apply to licensed physicians and surgeons or ordained clergy in emergency situations.

(3) Temporary permission. The Chief of Police may temporarily suspend the enforcement of night parking restrictions specified herein when exceptional conditions are determined to exist. The Chief of Police shall record all such occasions and report the dates and circumstances to the Village Manager.[2]

B. School District parking lots. No person shall park a vehicle on any Shorewood School District property contrary to the provisions of any official posted signs erected on said property.

(1) North side, East Capitol Drive at North Cramer Street.

(2) South side, East Capitol Drive at North Bartlett Avenue.

(3) South side, East Capitol Drive at North Larkin Street.

(4) South side, East Capitol Drive at North Newhall Street.

(5) West side, North Oakland Avenue at East Jarvis Street.

§ 500-22 Angle parking.

Except as otherwise provided within this section, angle parking is prohibited at all times in public streets in the Village. Angle parking shall be allowed as posted on the north side of East Shorewood Boulevard between North Frederick Avenue and North Murray Avenue.

§ 500-23 Bus stops.

Parking within 50 feet of the place where a bus stop sign has been erected is prohibited.

§ 500-24 Loading and accessible parking zones.

A. Definitions. As used in this section, the following terms shall have the meanings indicated.

ACCESSIBLE LOADING ZONE

A portion of a public street adjacent to a curb or property line reserved for the exclusive use of vehicles loading or unloading passengers with physical disabilities.

ACCESSIBLE PARKING ZONE

A portion of a public street adjacent to a curb or property line reserved for the exclusive use of parking for vehicles displaying special disabled parking license plates or a special disabled parking identification card as described in § 346.503(1), Wis. Stats., or vehicles registered in another jurisdiction displaying similar designations authorized by such jurisdiction.

B. Approval required. A special privilege permit shall be required via written application provided by the Planning and Development Department from the owner or lessee of property abutting the proposed loading, accessible loading or accessible parking zone. The Village Board may direct the Director of Public Works to designate and install accessible loading zones or accessible parking zones adjacent to public property.

(1) Loading zones. A special privilege permit for a loading zone shall be issued by the Village Board after review by the Planning and Development Director, Director of Public Works and Police Chief. The decision of the Village Board shall be final. All permits shall be for a period of one year or less and shall expire on the first day of May, unless sooner revoked by the Village Board.

(2) Accessible loading and accessible parking zones. A special privilege permit for an accessible loading zone or accessible parking zone shall be issued by the Planning and Development Director, after a feasibility review by the Director of Public Works and Police Chief, or their designees, to confirm the presence of an adequate, unprohibited parking space adjacent to the curb or property line of the applicant. If the application is adjacent to residential property, the applicant shall confirm receipt of a permanent disabled parking license plate or identification card. The decision of the Planning and Development Director may be appealed to the Village Board. The decision of the Village Board shall be final. All permits shall be for a period of one year or less and shall expire on the first day of May, unless sooner revoked by the Planning and Development Director.

C. Prior approvals revoked. No loading, accessible loading or accessible parking zone shall be valid, except as authorized by Subsection B. All approvals for loading or accessible parking zones granted before November 19, 2018, are hereby revoked and may be reissued only in accordance with the provisions of Subsection B.

D. Fee required. No permit for a loading zone shall be issued unless there is paid to the Village Clerk a fee in accordance with the Village Fee Schedule.[1] The fee shall be waived for governmental units. There shall be no fees for accessible loading or accessible parking zones.

§ 500-25 Residential parking permits.

A. Definitions. As used in this section, the following terms shall have the meanings indicated:

COMMUTER VEHICLE

A motor vehicle parked in a residential district by a person not a resident thereof.

PERMIT PARKING DISTRICT

An area where parking is limited to no more than two hours unless the vehicle displays a permit as provided in this section.

RESIDENTIAL DISTRICT

An area in which 75% of the district is occupied by one- and two-family dwellings. Residential districts shall be established only on an area basis.

B. Permit parking in residential permit parking districts.

(1) Whenever the Village Board shall determine that the streets of a particular residential area are being used for parking by commuter vehicles and that the average number of vehicles of that kind parking in said area is in excess of 25% of the number of parking spaces on such streets, and the total number of spaces actually occupied by any vehicles exceeds 65% of the number of spaces on such streets, the Village Board may, by ordinance, prohibit parking for more than two consecutive hours between 8:00 a.m. and 4:00 p.m., except Saturdays, Sundays and holidays, in said area. In such cases, the Village Board may cause appropriate signs giving notice of the prohibition to be posted on those streets restricting all parking beyond two hours, except parking by holders of permits. Permits may be issued to persons who reside in the particular area in which parking is so restricted to be limited to that particular area in which parking is so restricted for every vehicle owned and registered in the Village by a resident of the particular area.

(2) Permits shall be numerically coded to identify the parking permit district in which they shall be valid for parking. Each parking permit district shall be assigned a different code for permits issued under this chapter for the purpose of identifying the districts for which such permits apply.

C. Exemptions.

(1) The parking prohibitions contained herein shall not apply to service or delivery vehicles which are actually being used to provide services or make deliveries in a permit parking district.

(2) A petition requesting the exemption of a particular street segment of a permit parking district signed by 50% or more of the residents of that street segment will automatically exempt that particular street segment from the restricted parking regulations.

(3) The parking of motor vehicles registered under § 341.14(1) and (1a), Wis. Stats., by disabled persons exempt under § 346.50(2) and (2a), Wis. Stats., is exempt hereunder.

(4) The parking prohibition contained herein shall not apply to the vehicles of guests of a resident in a permit parking district for one day only, if by telephone or in person a resident obtains permission from the Police Department for such exemption and gives such information as required by the Department for the purposes of verification.

(5) The parking prohibition contained herein shall not apply to the vehicles of guests of a resident in a permit parking district if a special written permit is obtained by a resident from the Police Department, in advance, the terms of which shall be limited to a maximum of 14 days each year for each vehicle under such permit.

D. Procedure for designating a residential area as a permit parking district.

(1) In order to determine whether a particular residential area should be designated as a residential permit parking district, the staff shall conduct, upon submission of a petition signed by 50% or more of the residents of such area, or upon recommendation of the Traffic Safety Commission, an engineering survey to determine whether the criteria described heretofore establish the area as one qualified to become a permit parking district having the parking restrictions.

(2) To determine whether a particular area qualifies to have restricted parking, the designated area will be surveyed by the Planning and Development Department as follows: a block-by-block survey of the affected area will be taken. If more than 65% of the parking spaces are occupied by parked vehicles, then no further vehicle counts will be made. If 65% of the spaces are not occupied but it may be expected that the sixty-five-percent level may be obtained, then additional parked vehicle counts shall be made until an average of 65% is found or rejected. In those residential areas where 65% of the parking spaces are occupied, a study will be made to determine whether or not those persons using the spaces in that area are residents of that area. If more than 25% of the parking spaces are occupied by commuter vehicles, the area may be qualified to have restricted permit parking.

(3) In making its recommendation to the Board, the staff should consider such matters as:

(a) The availability of an alternate means of transportation to and from the proposed restricted district;

(b) Air pollution caused by automobile traffic within that district;

(c) The environmental impact of automobile use in the district;

(d) The likelihood of alleviating traffic congestion, illegal parking and related health and safety hazards;

(e) The proximity of public transportation to the residential district;

(f) The possibility of a reduction in total vehicle miles driven in and to the Village of Shorewood; and

(g) The desire and need of the residents of the district for residential permit parking and their willingness to bear the administrative costs in connection therewith.

(4) Each permit parking district, for the purpose of this section, shall include and be no smaller than both sides of the street commencing at an intersection and extending 300 feet therefrom or, in the alternative, both sides of the street between two intersecting streets or between an intersecting street and a cul-de-sac.

(5) Those streets where parking is restricted to no more than two hours during a particular time of any day at the time of the passage of this section shall be presumed to be impacted by commuter vehicles and eligible to be declared a permit parking district; a staff survey determination and recommendation in such case shall be waived hereunder.

E. Issuance of permits to residents.

(1) After said survey has been completed and submitted to the Village Board and the survey discloses that more than 25% of the parking spaces in the area are occupied by commuter vehicles and more than 65% of the available spaces are occupied, said Board may declare the area a permit parking district and shall authorize the Village Clerk's office to issue on-street daytime parking permits to the residents and business employees of the district per the Village of Shorewood Fee Schedule.[2]

(a) Before a permit will be issued, the applicant must provide proof of residence and of vehicle registration in the Village for each vehicle requiring a permit. Business employees must provide proof of employment and have a valid vehicle registration at the time of the application.

(b) As an alternative to conducting a survey and meeting the criteria required herein, the Board can establish permit parking districts in the Village and authorize the issuance of permits in accordance with the authority granted to the Village under § 349.13(1g), Wis. Stats., incorporated by reference in § 500-2 of this chapter.

(2) Notice must be sent to each household affected within the Village stating that the household is in a permit parking district and that the occupants of that household are able to obtain a permit for each vehicle parking in such restricted district if they are desirous of such a permit.

(3) Any such person applying for a permit shall show to the Police Department satisfactory evidence that he fulfills all the conditions for such permit. Whenever the conditions no longer exist, the person holding such permit issued under this section shall surrender it to the Police Department. It shall be unlawful for any person to represent that he is entitled to such a permit when he is not so entitled, to fail to surrender a permit to which he is no longer entitled, or to park a vehicle displaying such a permit at any time when the holder of such permit is not entitled to hold it. A permit issued hereunder shall not be valid for more than one year but may be renewed upon expiration, provided that the conditions for issuance exist and the annual fee per vehicle is paid.

F. Special exceptions. A special exception may be granted from the imposed parking restriction by the Chief of Police or his designee for good cause shown because of unique circumstances or hardship, to be determined at the sole discretion of the Chief or his designee.

G. Following the designation of a parking permit district, the Village Board shall cause parking signs to be posted in the area indicating the following types of parking restrictions:

(1) One-hour parking, 8:00 a.m. to 4:00 p.m., except Saturdays, Sundays, holidays and by permit.

(2) Two-hour parking, 8:00 a.m. to 4:00 p.m., except Saturdays, Sundays, holidays and by permit.

H. Locations of residential daytime parking permit districts.

(1) District A. The west side of Prospect Avenue bounded by East Capitol Drive on the south, to Jarvis Street on the north, where parking is restricted to a two-hour limitation at certain times without permit.

(2) District B. The west side of Downer Avenue bounded on the south by the area 120 feet north of Capitol Drive, to Jarvis Street on the north, where parking is restricted to a two-hour limitation at certain times without permit.

(3) District C. West side of North Newhall Street from the south right-of-way of East Kenmore Place to a point approximately 301 feet south thereof; east side of North Newhall Street from the south right-of-way line of East Kenmore Place to a point approximately 423 feet south thereof, where parking is restricted to a one-hour limitation at certain times without a permit.

(4) District D. East Elmdale Court between North Oakland Avenue and North Murray Avenue, where parking is restricted to a two-hour limitation at certain times without a permit.

(5) District E. East Kenmore Place, between North Oakland Avenue and North Newhall Street, where parking is restricted to a two-hour limitation at certain times without a permit.

(6) District F. East Pinedale Court from North Morris Boulevard west thereof to the end of said street, where parking is restricted to a two-hour limitation at certain times without a permit.

(7) District G. North side of East Lake Bluff Boulevard from North Bartlett Avenue to North Morris Boulevard, where parking is restricted to a two-hour limitation at certain times without a permit.

(8) District I. The 3800 block of North Newhall Street, where parking is restricted to a two-hour limitation at certain times without a permit.

I. Residential Congested Commuter Area.

(1) Pursuant to the authority of § 349.13 (1)(g) Wis. Stats. and notwithstanding any other provisions of this article regarding the creation of residential parking district, a Residential Congested Commuter Area is established for the area of the Village of Shorewood bounded by Lake Drive on the east, the north side of Capitol Drive on the north, the east side of Oakland Avenue on the west and Edgewood Avenue on the south. The regulations set forth herein in this Subsection I shall be applicable in the Residential Congested Commuter Area notwithstanding any other hourly parking restrictions set forth in this article and whereby vehicles bearing valid resident-only parking permits issued pursuant to this subsection may be parked without regard to posted hourly parking prohibitions within the area.

(2) Two-hour parking limit. Upon adoption of this subsection, parking signs shall be posted in the Residential Congested Commuter Area indicating that parking is restricted to two hours, 8:00 a.m. to 6:00 p.m. except Saturday, Sunday, holidays and by permit. No person shall park a vehicle in excess of the time limits within the Residential Congested Commuter Area unless the vehicle displays a valid Residential Congested Commuter Area parking permit as authorized under this Subsection I.

(3) Parking permitted.

(a) A person whose residence is either a single-family or duplex residence and lies within the Residential Congested Commuter Area may apply for a resident-only parking permit. During designated times, the holder of a resident-only parking permit shall be permitted to stand or park the vehicle to which the permit applies in the Residential Congested Commuter Area without regard to posted parking prohibitions. A resident-only parking permit shall not guarantee or reserve to the holder a parking space within the Residential Congested Commuter Area parking district.

(b) Any person eligible for a Residential Congested Commuter Area parking permit and whose single family or duplex residence lies within the Residential Congested Commuter Area may obtain two parking permits per household for parking two vehicles in the Residential Congested Commuter Area parking district.

(c) A person whose residence is either a tri-plex or multi-unit residence and lies within the Residential Congested Commuter Area may apply for a resident-only parking permit. During designated times, the holder of a resident-only parking permit shall be permitted to stand or park the vehicle to which the permit applies in the Residential Congested Commuter Area without regard to posted parking prohibitions. A resident-only parking permit shall not guarantee or reserve to the holder a parking space within the Residential Congested Commuter Area parking district.

(d) Any person eligible for a Residential Congested Commuter Area parking permit and whose triplex or multi-unit residence lies within the Residential Congested Commuter Area may obtain one parking permit per household for parking one vehicle in the Residential Congested Commuter Area parking district.

(e) Upon creation of the Residential Congested Commuter Area residential parking district, the Village shall cause appropriate parking signs to be erected in the area, indicating that parking is restricted to two hours, 8:00 a.m. to 6:00 p.m. except Saturday, Sunday, holidays and by permit and the Village of Shorewood is authorized to issue appropriate permits upon application by eligible residents. A permit shall be issued upon application and payment of an applicable fee, if any, only to the owner or the operator of a motor vehicle who resides on property immediately adjacent to a street, avenue or other location within the residential permit parking area, subject to the conditions provided in this subsection. The applicable fee, if any, shall be set by resolution of the Village Board and shall remain in effect until amended or repealed. Permits may be renewed annually by the Village of Shorewood.

(f) Application and permit information. The application form shall contain the name, address and Wisconsin driver's license number of the owner or operator of each vehicle, and the make, model and registration number of each vehicle. At the time of application, each applicant must present to the Village of Shorewood a valid driver's license with the same address as that stated on the application for each vehicle listed on the application. Each vehicle must have valid Wisconsin motor vehicle license plates that are currently registered and not suspended or revoked for any reason. If the owner of the vehicle has applied for, but not received Wisconsin license plates, the Village shall accept a receipt of sale and a copy of the license plate application as proof of registration; however, the owner upon receipt of the license plate shall within a reasonable time notify the Village of the license plate number.

(g) Only the registered motor vehicle named on the Residential Congested Commuter Area residential parking permit shall be eligible to display this permit. Any transfer of this permit to a vehicle other than that named on the permit shall constitute a violation of this regulation. The Police Department is authorized and directed to revoke the parking permit of any permittee found to be in violation of this regulation and, upon written notification thereof, the permittee shall surrender such permit to the Police Department. Failure, when so requested, to surrender a residential parking permit so revoked shall constitute a violation of this regulation.

(h) Service vehicles and guests shall be allowed to park within the Residential Congested Commuter Area residential parking district without regard to posted parking prohibitions provided that single-day parking permission has been obtained from the Police Department. A vehicle license plate and an applicable address within the Residential Congested Commuter Area residential parking district shall be recorded.

(i) A Residential Congested Commuter Area residential parking district permit shall not authorize the holder thereof to stand or park a motor vehicle in places where parking or stopping is otherwise prohibited by §§ 346.52 and 346.53, Wis. Stats., or the other provisions of the Shorewood Code regulating where parking is prohibited (§§ 500-14, 500-17, 500-18, 500-23), or restricted as a loading zone (§ 500-24), or regulated by the winter parking restrictions (§ 500-26), nor exempt the holder from the observance of any traffic regulation other than the posted two-hour parking prohibition.

§ 500-26 Winter parking.

§ 500-27 Removal of illegally parked vehicles.

[Amended 12-5-1994 by Ord. No. 1703]

A. It shall be unlawful for any person to leave a vehicle upon a public street or highway in violation of a lawful prohibition, limitation or restriction on stopping, standing or parking as provided in § 349.13(3), Wis. Stats.

B. Included within this regulation shall be vehicles stopping, standing, or parking on a public street or highway where official temporary "No Parking" signs have been erected by the Village to protect the public health, safety or welfare for reasons which shall include, but shall not be limited to because of the enumeration, street maintenance, repair or construction; maintenance of streetlighting; maintenance, repair or construction of water or sewer mains or laterals; snow removal; street cleaning; and removal or erection of buildings or structures.

C. Included within this regulation shall be vehicles stopping, standing, or parking on a public street or highway where the vehicle is unregistered as defined in § 500-14D(1), pursuant to § 341.65, Wis. Stats.

D. Included within this regulation shall be vehicles stopping, standing, or parking on a public street or highway where the vehicle identification number (VIN) as defined in § 500-14E(1), is removed, altered, obliterated, or otherwise made impossible to read, pursuant to § 342.30(1g)(a), Wis. Stats.

E. Included within this regulation shall be vehicles stopping, standing, or parking on a public street or highway where the vehicle has three or more unpaid parking citations in excess of 60 days in violation of Shorewood Village Ordinance §§ 500-14 through 500-31, pursuant to § 345.28, Wis. Stats.

F. Vehicles which are stopped, standing or parked in violation of Subsection C may be moved as provided in § 342.30(4)(a), Wis. Stats., for which the Village may charge the owner of such vehicle a reasonable sum to cover the cost of said removal, not to exceed $100. As an alternative, the Village may have the vehicle moved by a private contractor, and in such case the owner of such vehicle shall be liable to the contractor for the payment of the charges incurred.

(1) Upon determining that an unregistered motor vehicle is parked in violation of Subsection A, police personnel shall issue a parking citation for "unregistered vehicle" in violation of § 341.65, Wis. Stats. Police personnel shall affix a notice to the vehicle warning that the vehicle will be towed and impounded if the registration is not updated within three days or proof is provided that an application for vehicle registration has been submitted.

(2) A notice informing the owner of the location of the vehicle and the procedure for reclaiming the vehicle shall be mailed to the owner's last known address within 24 hours after removal.

G. Vehicles which are stopped, standing, or parked in violation of Subsection D and E may be moved as provided in § 342.30(4)(a), Wis. Stats., for which the Village may charge the owner of such vehicle a reasonable sum to cover the cost of said removal, not to exceed $100. As an alternative, the Village may have the vehicle moved by a private contractor, and in such case the owner of such vehicle shall be liable to the contractor for the payment of the charges incurred.

(1) Any officer who encounters a vehicle on any alley, street, highway, or public place within the Village of Shorewood, on which the identification number has been removed, altered, obliterated, or made impossible to read, including any vehicle on which the identification number is not readily visible when observed from outside the vehicle, shall affix a notice to the vehicle warning that the vehicle will be impounded within three days unless steps are taken to allow for proper identification of the vehicle.

(2) Officers encountering an illegally parked vehicle should issue the appropriate citation and review the vehicle status. Upon determining that the vehicle has excessive parking citations violating Village of Shorewood Ordinance §§ 500-14 through 500-31, officers shall affix a notice to the vehicle warning that the vehicle will be impounded if the citations are not paid, or a court appearance is scheduled within three days.

(3) After three days have passed and the owner has neither paid the forfeiture for each of these violations or scheduled an appearance in court in response to each of these citations, officers can initiate the towing procedures.

§ 500-28 Owner presumed to be operator of vehicle.

Whenever any vehicle is found upon a Village street or highway in violation of any provision of the Village Code regulating the stopping, standing or parking of vehicles and the identity of the operator cannot be determined, the owner as shown by the ownership registration of the vehicle furnished by the Wisconsin Department of Transportation, or a comparable authority of any other state, shall be presumed to be the operator and shall be subject to appropriate penalties as enumerated in this chapter.

§ 500-29 Parking on private property.

No person, without the permission of the owner or lessee of any private property, shall leave or park any motor vehicle thereon, contrary to a posted sign erected thereon, if there is in plain view on such property a "No Parking" sign or a sign indicating limited or restricted parking. Owners or lessees of such property may prohibit parking, may restrict or limit parking, and may permit parking by certain persons and prohibit it or limit it as to other persons.

§ 500-30 Municipal parking lots.

A. No person shall park a motor vehicle other than vehicles with passenger license plates, trucks under one ton and motorcycles in any municipal parking lot in the village of Shorewood, subject to posted signs erected in each lot containing the following regulations:

(1) Hubbard Park Parking Lot. Four-hour parking: 8:00 a.m. to 8:00 p.m., except Sundays and holidays. Off-street overnight parking by permit only: 12:00 a.m. to 6:00 a.m.

(2) Menlo Parking Lot (3595 North Oakland Avenue). Two-hour parking: 8:00 a.m. to 7:00 p.m., except Sundays, holidays and permit holders. Off-street overnight parking by permit only: 12:00 a.m. to 6:00 a.m.

(3) Oakland North Parking Lot (4448 and 4450 North Oakland Avenue). Two-hour parking: 8:00 a.m. to 6:00 p.m., except Sundays, holidays and permit holders. Off-street overnight parking by permit only: 6:00 p.m. to 6:00 a.m.

(4) River Park Parking Lots. Two-hour parking: 8:00 a.m. to 7:00 p.m., except Sundays, holidays and permit holders. Off-street overnight parking by permit only: 12:00 a.m. to 6:00 a.m.

(5) Village Hall/Village Center Parking Lot. Four-hour parking: 8:00 a.m. to 8:00 p.m., except Sundays, holidays, or as otherwise posted. Off-street overnight parking by permit only: 12:00 a.m. to 6:00 a.m. unless otherwise posted.

B. Off-street parking permits.

(1) Vehicles shall first obtain an off-street parking permit from the Village after filing an application and paying a permit fee, all as required under this section, and shall be parked as authorized by such permit.

(2) Any motortruck with valid license plates issued by the Wisconsin Department of Transportation, Division of Motor Vehicles, but not used for commercial purposes, and which is not larger than 21 feet in length, seven feet in width, and seven feet in height, and which has no more than two single-tired wheels on the front axle and no more than two single-tired or doubled-tired wheels on the rear axle, shall be eligible to obtain an off-street parking permit as provided in this section.

(3) Any vehicle for which a person is applying for an off-street parking permit may be inspected for purposes of determining eligibility for the permit as provided in this section.

(4) Vehicles that obtain an off-street parking permit must also display, while parked, valid motor vehicle license plates.

(5) Certain vehicles not eligible. Motortrucks, except as provided elsewhere in this chapter, luxury limousines, motor buses, motor delivery wagons, trailers, semitrailers, camping trailers, motor homes, mobile homes and tractors shall not be eligible for off-street parking permits.

(6) Application and permit.

(a) The application shall contain the name and address of the permit applicant, the license plate number and state of issuance of valid motor vehicle license plates and any other reasonable and pertinent information the Village may from time to time require. A statement shall be included in the application that the vehicle for which the application is made does not violate Subsection B(2) and (5).

(b) The permits shall contain the expiration date.

§ 500-31 Temporary no-parking zones.

A. The Director of the Department of Public Works is authorized to establish temporary no-parking zones as may be required to facilitate the activities of the Department in construction projects, street and utility maintenance and repair, refuse and recycling collection, leaf and yard waste collections, and for those other activities which, in the determination of the Director of Public Works, could be carried out more safely and efficiently with the creation of a temporary no-parking zone.

B. On the creation of a temporary no-parking zone, the Director of Public Works is authorized to erect temporary "No Parking" signs in the area in which the work is to be completed and to allow the signs to remain until a reasonable period of time after the completion of that part of the project for which the temporary no-parking zone had been made.
