As used in this article, the following terms shall have the meaning indicated unless a different meaning clearly appears from the context:
HIGHWAY
The entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public for purposes of vehicular travel.
PLAY HIGHWAY
A highway which is used for play and recreational activities as permitted during specific times and periods established in this article or otherwise authorized by an appropriate designated Borough official. Play highways should be clearly blocked and appropriate notices provided for such use during those times and periods for which the highway is in use as a play highway.
A. 
The following areas upon the streets and highways in the Borough of Jim Thorpe are established as play highways:

5th and 6th Streets
Monday through Friday during the school term and on those days when school is in session
11:15 a.m. to 1:30 p.m.
B. 
The Chief of Police of the Borough of Jim Thorpe is authorized to designate as play highways, whenever he deems that action advisable, and for whatever period of time directed by him, any part of any street in the Borough of Jim Thorpe, where play and recreation activities shall be permitted. That play highway shall be set apart for the purpose under the direction of the Chief of Police of the Borough of Jim Thorpe.
C. 
No person shall drive any motor vehicle upon any play highway at any time when that street shall be designated as a play highway, except in case of emergency, with special permission of the Chief of Police of the Borough of Jim Thorpe or of the police officer in charge, who shall first clear that play highway of all persons using it for the purpose for which it was set aside.

Any person who violates a provision of this article shall, upon conviction, be subject to the appropriate penalties set forth in the Pennsylvania Vehicle Code (75 Pa.C.S.A. § 101 et seq.) for each provision so violated.
