A. Violation of any provision of this chapter shall be
cause for an enforcement document to be issued to the violator by
the Eatontown Borough Special Code Enforcement Officer or other official
or enforcing agency designated by the Mayor and Council. The recipient
of an enforcement document shall be entitled to a hearing in the Municipal
Court having jurisdiction to contest such action.
B. Any person who violates any provision of this chapter
shall be subject to a civil penalty for each penalty of not more than
$1,250, imprisonment for a term not exceeding 90 days, a period of
community service not exceeding 90 days, or any combination thereof.
If the violation is of a continuing nature, each day during which
it occurs shall constitute an additional, separate and distinct offense.
C. No provision of this chapter shall be construed to
impair any common law, statutory or regulatory cause of action or
legal remedy therefrom, or any personal injury or damage arising from
any violation of this chapter or from other law.
In addition to the powers given to the Zoning
Officer as aforesaid, the owner of any property in the Borough of
Eatontown may make complaint for any violation of this chapter or
any provision or section thereof and upon conviction in such case
the penalties hereinbefore provided shall be imposed.
In addition to the remedy or remedies hereinbefore
provided, any person, persons, company or corporation violating this
chapter or any provision or section thereof may be proceeded against
by the Borough of Eatontown or by the Zoning Officer of the Borough
of Eatontown or by the owner of any property in the Borough of Eatontown
by appropriate action or by proceeding in equity or otherwise to prevent
and enjoin any threatened violation or any existing violation or any
continuing violation of this chapter or any provision or section thereof.
