As used in this article, the following terms shall have the meanings indicated:
COMMERCIAL COLLECTOR
All persons or corporations or other enterprises engaged in the business of collecting rubbish, garbage and other waste materials, as defined in this article, on a contract or other basis, for a consideration.

GARBAGE
Includes waste food, papers and all waste or vegetable matter of any kind or any other matter which shall be flammable or capable of fermentation or decay, but shall not include dead animals or parts thereof.
LOAD
A quantity of refuse, garbage, rubbish or other waste, as defined in this article, containing not more than 20 cubic yards.

PERSON
Includes an individual, society, club, firm, partnership, corporation or association of persons, and the singular number shall include the plural number.
REFUSE
All putrescible solid waste, except body wastes, including, but not limited to, household garbage, rubbish, ashes, street cleaning debris, dead animals, abandoned automobiles, dismantled automobiles and parts thereof, scrap metal, junk, machinery and solid market and industrial wastes.

RUBBISH
Includes waste metal, tin cans, ashes, cinders, glass, pottery and all discarded substances of a solid and incombustible nature.

The premises owned by the Town of Union Vale, situate in said Town of Union Vale, located on the southerly side of the state highway known as Route 55, and bounded on the north and east by NYS Route 55, on the west by parcel 437115-00-6660 and on the south by lands in the Town of Beckman are designated as the recycling center of this Town for the disposal of refuse from the residents of the Town, subject to the provisions of this article. The regulations herein contained shall also apply to any other lands hereafter acquired or leased for the purpose of disposal of refuse.

No person shall carry or leave or cause to be carried or left upon the premises mentioned in § 188-2 of this article, any automobile, vehicle, machine or other article, or any large part thereof. Appliances and other bulk items listed on the Union Vale Bulk Item Disposal list may be disposed of for a fee to be set by the Town Board.
No person shall carry or leave or cause to be carried or left upon the premises mentioned in § 188-2 of this article, any material, waste or offal of any kind which shall or may thereafter create a nuisance of any kind or which shall be or may become dangerous to human or animal life.

No person not a resident of or conducting an established business in the Town of Union Vale shall deposit any refuse or garbage of any kind on the premises herein designated for that purpose. To use the recycling center nonresidents may purchase a nonresident recycling permit from the Town Clerk.

No person shall deposit or cause to be deposited any substance of any kind at the recycling center, except at the places and in the manner directed by the person in charge of the premises under the authority of the Town Board, whether such direction is given personally or by another person by his authority or by a sign or signs erected upon the premises by his authority.

No person shall throw or deposit or cause to be thrown or deposited any garbage, refuse, or abandoned vehicles or parts thereof in or upon any public highway, street or place within the Town of Union Vale, except within the recycling center aforesaid, pursuant to the regulations herein.

All commercial collectors depositing garbage, rubbish or other waste materials as defined in this article on the Town site as described in this article shall pay an annual fee as set from time to time by resolution of the Town Board. No commercial collectors shall be permitted to deposit garbage, rubbish or other waste, as defined in this article, collected outside the corporate limits of the Town of Union Vale.[2]

Any person violating any of the provisions of this article shall, upon conviction thereof, be punishable by a fine not exceeding $250 or by imprisonment for not more than 15 days, or both, for each offense.
Any person who or whose servants, agents, employees or officers shall be convicted of a violation hereof may thereafter be denied the use of such recycling center, either temporarily or permanently, by the officer or employee in charge thereof or by resolution of the Town Board.

This article shall be known as the "Mandatory Separation of Paper, Glass, Plastic and Aluminum Law of the Town of Union Vale."
The Town Board acknowledges that the cost of solid waste disposal is rapidly increasing, while at the same time solid waste disposal capacity within existing regulations is limited in the Town and, in general, within the region. By establishing a mandatory program of recycling by separating paper, glass, plastic and aluminum from garbage and trash, the life of existing disposal facilities will be extended by reducing the amount of solid waste to be disposed of and, in turn, will reduce the overall cost of solid waste disposal.
A program for the mandatory separation of paper, glass, plastic and aluminum from garbage and trash to be disposed of within the Town of Union Vale is hereby established. All residents who utilize the Town transfer station for the disposal of their garbage and trash shall separate therefrom all paper, glass, plastic and aluminum before disposing of any garbage or trash in the compactor located at the transfer station.
As used in this article, the following terms shall have the meanings indicated:
ALUMINUM
All disposable items made from the metal aluminum, including but not limited to all containers used for soda, beer, other beverages and food, foil wrappers, containers for prepared food and lawn chairs (fabric removed).
GARBAGE
Putrescible animal, fish, foul, fruit or vegetable waste incident to and resulting from the use, preparation, cooking and consumption of food.
GLASS
All products made from silica or sand, soda ash and limestone, the product being transparent or translucent and being used for the packaging or bottling of various matter and all other material commonly known as "glass," excluding, however, ceramics, light bulbs, blue and flat glass and glass commonly known as "window glass."
PAPER
A substance made in the form of thin sheets from bark, wood or other fibrous material, including but not limited to newspapers and magazines.
PLASTIC
All containers made from high-density polyethylene, including but not limited to bottles having contained the following types of liquid: milk, juice, water, soap, bleach, detergent, oil, antifreeze, carbonated beverages and auto window-washing fluid.
RECYCLABLE MATERIALS
Paper, corrugated cardboard, glass, plastic, aluminum, metal, waste oil, fluorescent bulbs, and rechargeable batteries.

TRASH
All nonputrescible solid waste.
ZONING ENFORCEMENT OFFICER
The Town of Union Vale Code Enforcement Officer.
All residents who use the Town transfer station shall, prior to using the facility, separate from their garbage and trash all paper, glass, plastic and aluminum. All categories of recyclable material, as defined in this article, shall be disposed of in separate containers that shall be made available at the transfer station. Once deposited in the containers provided, all recyclable materials become the property of the Town of Union Vale.
Nothing in this article shall prohibit or prevent any private property owner, tenant or property user from securing a private contract for the removal of garbage and trash, including those items defined as recyclable material in § 188-14.
No person shall take or remove any recyclable material from the Town of Union Vale transfer station unless authorized to do so by the Town Board of the Town of Union Vale.
The governing body of the Town of Union Vale may from time to time, by resolution, promulgate rules and regulations consistent with the provisions of this article in order to effectuate the purposes hereof.
Any person, firm, business, corporation or other entity who violates or fails to comply with any provision of this article or any rule or regulation promulgated pursuant thereto shall, upon conviction thereof, be punished by a fine not to exceed the following amounts for the following offenses:
A. 
First offense: a fine of not more than $50.
B. 
Second offense: a fine of not more than $100.
C. 
Subsequent offenses: a fine of not more than $200 and denial of access to the transfer station for one year from the date of conviction.
The transfer station attendant and the Town of Union Vale Zoning Enforcement Officer are hereby authorized to enforce this article and any rules and regulations established pursuant thereto.
Anything herein to the contrary notwithstanding, any person using the transfer station may donate or sell recyclables to any person, partnership, business, corporation or other entity, whether operating for profit or not for profit.

A. 
Compact fees shall be $50 per sticker[1] and $2 per thirty-three-gallon bag.[2]

Editor's Note: Per meeting of 1-2-1990, this fee of $50 shall include the spring and fall cleanup at no extra cost to residents of Union Vale. The recycling center will be open Wednesday, Saturday and Sunday from 8:00 a.m. to 4:00 p.m.
B. 
There shall be a fee of $4 (two coupons) for bags over 33 gallons in size.

The fee for tires brought to the Recycling Center on Cleanup Days shall be $2 per tire.

Annual permit fees for use of the transfer station by nonresidents of Union Vale shall be as follows:
