[Adopted 4-8-2008 by L.L. No. 5-2008]
The Town Board finds that it is sometimes difficult
to maintain a quorum on the Planning Board and Zoning Board of Appeals
because members are ill, unable to attend, on extended vacation, or
find they have a conflict of interest on a specific matter before
the Board. In such instances, official business cannot be conducted
which may delay or impede adherence to required timelines. The use
of alternate members to serve when members are absent or are unable
to participate on an application or matter before the respective Board
in such instances is hereby authorized pursuant to the provisions
of this article.
This article is hereby adopted pursuant to the
authority contained in Municipal Home Rule Law § 10. It
is the intent of the Town Board to supersede the provisions of §§ 271(15)
and 267(11) of the Town Law, relating to the appointment of alternate
members, to amend and expand the circumstances under which an alternate
member of the Planning Board or Zoning Board of Appeals may serve.
