The Town Board finds for the reasons set forth
herein that it is in the best interest of the Town of Greenburgh to
assist the Fairview Fire District in providing state-of-the-art fire-fighting
capability Town-wide. The Town Board is mindful that more than 40%
of the assessable amount of all properties in the Fairview Fire District
is tax exempt, in significant part because of Town-owned or operated
properties located therein. The Town Board is also mindful of data
and documentation which indicates that the Fairview Fire District
regularly responds to a significant number of calls to properties
under Town control or contract, as well as responds to a disproportionate
number of mutual aid calls outside of its district boundaries. As
a result of these data, the Town Board further finds that assisting
the Fairview Fire District to fund, when financially practicable,
equipment, supplies and programs that serve to promote the health,
welfare and safety of residents Town-wide and enhance the fire-fighting
capability, training and protection of firefighters who serve a Town-wide
public purpose, providing both emergency and nonemergency services
to all areas of the Town of Greenburgh, serves a Town-wide public
purpose.
The following terms in this article shall have
the meanings indicated:
FAIRVIEW FIRE DISTRICT
The fire district located in the unincorporated area of the
Town of Greenburgh in which the Fairview Fire Department has its headquarters.
FIRE-FIGHTING-RELATED EXPENSES
All equipment, supplies and programs that serve to provide
enhanced Town-wide fire-fighting capability, training and protection
and/or promote education about fire safety and fire prevention to
residents Town-wide.
TOWN-WIDE
The Town of Greenburgh, including its incorporated villages.
Prior to October 1 in any fiscal year, the Fairview
Fire District Fire Chief may present to the Town Board, for its consideration
and approval, a list of equipment, supplies and programs that the
District proposes to be purchased or undertaken the ensuing fiscal
year, together with a proposed budget showing the cost thereof, and
justification to support their Town-wide public purpose. Upon submittal
of the said list and budget, and copies of the receipts for prior
approved expenditures, the Town Board shall, by December 20, approve
or deny the District's fiscal year funding request. In considering
whether to approve or deny the District's funding request the Town
Board shall consider whether expenditures made during the preceding
fiscal year correlate with the proposed expenditures approved by the
Town Board, the fiscal condition of the Town, the availability of
Town funds, the submitted written justification to support the Town-wide
public purpose of the requested items, the impact of Town-owned, contracted
or operated tax-exempt properties on the Fairview Fire District budget,
and the availability of funds from other sources to fund the request(s).
This article shall not apply to:
A. Expenditures for fire-fighting-related expenses not
serving a Town-wide public purpose.
B. Equipment, supplies and programs already funded, regardless
of the funding source.
The Town Board is hereby authorized, empowered
and directed to promulgate such rules and regulations that are lawful,
necessary and appropriate for the implementation and enforcement of
the provisions of this article after consulting with the Town Building
Inspector and Fire Marshal regarding the Town-wide public purpose
that would be provided by the fire-fighting equipment, supplies and
programs requested.
