The purpose of this Article is to set minimum public liability insurance
requirements for all school bus operators doing business for or in the Town
of Griswold.
As used in this Article, the following terms shall have the meanings
indicated:
SCHOOL BUS OPERATOR
Any person, firm, partnership, corporation or entity of any nature
in the business of supplying transportation by school bus, whether gratuitously
or for monetary payment, of pupils to and from school or school activities.
All school bus operators doing business for or in the Town of Griswold
shall maintain a motor vehicle liability policy reflecting property damage
liability insurance coverage in an amount not less than $1,000,000 per individual
and not less than $5,000,000 in the aggregate for any one accident and medical
insurance in an amount not less than $5,000 per individual.
A certificate of insurance complying with the requirements of this Article
shall be filed with the office of the Town Clerk of Griswold and the office
of the Superintendent of Schools on or before July 1 of each year. The certificate
must be issued by an insurance company or companies licensed to do business
in the State of Connecticut. The certificate of insurance shall indicate that
the Townshall receive 30 days' notice prior to any material change or
cancellation of the insurance coverage.
Notwithstanding the provisions hereof, the Town of Griswold shall not
be liable in any matter or to any person whatsoever for the failure of any
school bus operator to be in compliance with the provisions hereof. Further,
any school bus operator(s) doing business for or in the Town of Griswold shall
agree to indemnify and save harmless the Town of Griswold and the Griswold
Board of Education, its officers, agents, employees and servants from and
against all liability claims of action, loss, damage or expense of any kind
and description whatsoever due to bodily injury, including death at any time
resulting therefrom, sustained by any person or persons or on account of damage
to property, including loss of use thereof, arising from said school bus operator.
