For the purposes of this chapter, the following terms shall have the meanings indicated:
JUNKYARD
An establishment in which articles that have outlived their usefulness in their original form are brought and sold to be converted into another product, either of the same or a different kind by some manufacturing process.
It shall be unlawful for any person, firm or corporation to establish, maintain or operate a junkyard or for any person, firm or corporation to establish, maintain, store or keep trash accumulations or any other indiscriminate accumulation of articles of any kind within the corporate limits of the Town of Millsboro; provided, however, that the above shall in no way apply to any person, firm or corporation who has appealed to and secured from the Town Council a permit to operate a licensed location for the purpose of storing for resale used articles, where said location is maintained in an acceptable and safe manner and complies with all town regulations pertaining to commercial establishments.
Any person violating any provisions of this chapter shall be deemed guilty of a misdemeanor and upon conviction therefor be fined not less than $20 nor more than $100 in addition to the cost of prosecution.
