For the purposes of this article, the following definitions
shall be applicable unless the context clearly indicates to the contrary:
WATERCRAFT
All craft used on water, whether operated manually or by motor.
No person under the age of 16 years shall operate any motor-propelled
watercraft without an adult being present and in direct supervision of the
operation of the watercraft.
All watercraft shall be equipped with personal flotation devices.
No person shall operate or permit to be operated any watercraft equipped
with a gasoline-powered motor having more than five horsepower.
No person shall fish or take fish from Millsboro Pond without first
obtaining a license therefor from the Department of Natural Resources and
Environmental Control; provided, however, that any person exempt from being
licensed to fish or take fish by the applicable laws of the State of Delaware
shall not be required to obtain such a license.
No person shall hunt from Millsboro Pond or Millsboro Pond Ramp.
Any person violating any of the provisions of this article shall be
deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined
not less than $25 nor more than $50 or imprisoned for a term of not more than
10 days, or both, and shall pay the costs of prosecution. For the purposes
of this article, each day that an offense occurs shall be deemed to be a separate
offense.
