This article shall be known and cited as the "Charter Township of Blackman Group Insurance Plan Ordinance."
Pursuant to Public Act 77 of 1989,[1] the Charter Township of Blackman hereby creates and establishes a group insurance plan covering life, health, hospitalization, medical and surgical service and expense and accident insurance of its officers and employees enumerated herein, and their dependents, and for such purposes, also hereby authorizes the Township Supervisor and the Township Clerk to contract in the name of the Township Board, subject to approval of the Township Board, with any company authorized to transact such business within the State of Michigan for such group insurance policies.

The group insurance plan created, established and contracted for under this article shall cover such persons within the following classes of officers and employees and shall also cover the dependents of such persons:
A. 
Members of the Township Board elected before December 2004.
B. 
All Township public safety officers, except volunteers.
C. 
All other regular full-time employees regularly scheduled to work 40 hours per week.

The Charter Township of Blackman shall annually contribute 100% of the premium or charges arising under such life insurance contract for each person within the class of persons enumerated in § 15-3 hereof. Additionally, the Charter Township of Blackman shall annually contribute a per centum set annually by Board resolution of that portion of the premium or charges under such health, hospitalization, medical and surgical service and expense and accident insurance contract for each person within the class of persons enumerated in § 15-3 hereof. Such Township contribution shall be secured from the general fund of the Township. Each person within such class shall be responsible for the remainder of the premium or charges not paid for by the Township, and the Township Treasurer is hereby authorized to deduct the same from each person's pay, salary or compensation and to apply to such person's responsibility. Any person desiring not to be so covered shall give written notice to the Township Clerk that he/she desires not to be insured or covered, and if the notice is received before the person has become insured or covered under the contract, he/she shall not be covered hereunder. If the notice is received after the individual has become insured or covered, his/her coverage under the contract shall cease as provided for in the contract.
The Charter Township of Blackman hereby ratifies and confirms the validity of any life, health, hospitalization, medical and surgical service and expense and accident insurance or any one or more of such forms of insurance in existence on the effective date of this article.

An ordinance to create and establish an annuity or pension plan for the officers and employees of Blackman Township and to authorize the Township Supervisor and the Township Clerk to contract, in the name of the Township, for such plan; to define those classes of officers and employees who shall be covered by such annuity or pension plan; to set forth the respective per centum shares which Blackman Township and the officers and employees shall contribute to the premium or charges arising under such annuity or pension contract and to further provide for the deduction of contributions from officers' and employees' compensation; to establish the time at which existing and future employees shall become eligible for such plan and to further establish the normal retirement date for all employees; to provide a method for noncoverage of an officer or employee of the annuity or pension plan; to set forth a date wherein each person covered under the annuity or pension plan shall have a vested right or interest in such plan; to ratify and confirm the validity of any annuity or pension plan in existence on the effective date of this article; and to repeal all ordinances or parts of ordinances in conflict herewith.
Pursuant to Act 27 of Public Acts of 1960, as amended,[1] the Township of Blackman hereby creates and establishes an annuity or pension plan and program for the pensioning of its officers and employees, and, for such purposes, also hereby authorizes the Township Supervisor and the Township Clerk to contract, in the name of the Township Board, with any company authorized to transact such business within the State of Michigan for annuities or pensions.

The annuity or pension plans created, established and contracted for under this article shall cover each person within the following class of officers and employees:
A. 
All members of the Township Board.
B. 
All other regular full-time employees regularly scheduled 40 hours per week not under a union contract.
C. 
All sworn, nonunion Public Safety Administrators shall be covered under the same pension plan with the same retirement conditions, benefits and financial contributions as agreed to in the collective bargaining agreements with the POAM and COAM unions.

A. 
The Township of Blackman shall annually contribute 12 1/2% of each employee's base wages into a pension plan account for each person within the class of officers and employees enumerated in § 15-8, provided that their employment started before November 1, 2006. For those hired after November 1, 2006, the contribution amount shall be 5%. Such contributions shall be secured from the general fund of the Township. Each person within such class of officers and employees shall be responsible for the remainder of the premium or charges, and the Township Treasurer is hereby authorized to deduct the same from each person's pay, salary or compensation and to apply the same to such person's responsibility.
B. 
Contributions for Township Board members shall be set by Board resolution.
A. 
Present employees. Each employee who is employed on the effective date of the annuity or pension plan shall be eligible for coverage on that day, provided he or she then meets the following requirements, otherwise to be eligible on the first policy anniversary on which he or she meets them:
(1) 
His or her age (nearest birthday) is at least 18 years and not more than 70 years.
B. 
New employees. Every employee who becomes subsequently employed shall be eligible on the first policy anniversary on which he or she meets the following requirements:

His or her age (nearest birthday) is at least 18 years and not more than 70 years.
An employee's normal retirement date shall be the policy anniversary of the annuity or pension plan nearest his or her 65th birthday, and early retirement at 55th birthday.
Any person desiring not to be so covered shall give written notice to the Township Clerk that he desires not to be covered, and if the notice is received before the person has become covered under contract, he shall not be covered thereunder. If the notice is received after the individual has become covered, his coverage under the contract shall cease as provided for in the contract.

Each person covered under the annuity or pension plan hired before October 1, 2006, shall have a 100% vested right or interest in such plan 20 months from the date the plan becomes effective for such person; provided, however, that each person covered under the annuity or pension plan hired after October 1, 2006, shall have a 50% vested right or interest in such plan at 30 months, 75% at 48 months, and 100% at 60 months from the date the plan becomes effective for such person.
