Pursuant to the provisions of Act 245 of 1999, and in particular Section
8b(6), MCLA § 125.1508b, the Charter Township of Blackman hereby
elects to assume responsibility for the administration and enforcement of
Public Act 245 of 1999, as amended, and enforce the Stille-DeRossett-Hale
Single State Construction Code Act within the Township limits.
These regulations shall be known as the "Building Code of the Charter
Township of Blackman," hereinafter referred to as "this code." A copy of said
code is on file in the office of the Charter Township of Blackman Clerk, 1990
W. Parnall Road, Jackson, Michigan.
The Charter Township of Blackman hereby designates the Township Building
Inspector of the Charter Township of Blackman as the enforcing agency to discharge
the responsibilities of the Township under this article.
The following sections of the Construction Code are hereby revised as
follows:

Unlawful continuance: Any person who shall continue any
work in or about the structure after having been served with a stop-work order,
except such work as that person is directed to perform to remove a violation
or unsafe condition, shall be liable to a fine of not less than $50 nor more
than $500.

Applicability: Structures existing prior to the effective
date of this article in which there is work involving additions, alterations,
or changes of occupancy shall be made to conform to the requirements of this
section or the provisions of Sections 3403.0 through 3407.0.

The provisions in Sections 3408.2.1 through 3408.2.5 shall apply to
existing occupancies that will continue to be, or are proposed to be, in Use
Groups A, B, E, F, M, R and S. These provisions shall not apply to buildings
with occupancies in Use Group H or I.

A fee for each plan examination, building permit and inspection shall
be paid in accordance with the fees adopted by the Charter Township of Blackman.
A Construction Board of Appeals for the Charter Township of Blackman
is hereby created and shall consist of three members. Each member of the Board
of Appeals shall be appointed for a two-year term. Appeals shall be heard
within 30 days.
Any person, firm, copartnership, company or corporation who shall violate
a provision of this code or shall fail to comply with any of the requirements
thereof or who shall erect, construct, alter or repair a building or structure
in violation of any approved plan or directive of the code official, or of
a permit or certificate issued under the provisions of this code, shall be
deemed guilty of a misdemeanor and shall be punished by imprisonment in the
county jail for not more than 90 days or by fine of not more than $500, or
by both fine and imprisonment. Each day that a violation continues after due
notice has been served shall be deemed separate offense.

The Charter Township of Blackman is authorized to recover its reasonable
costs of response, arrest and prosecution of ordinance violation and the Township,
desiring to recover such costs, this article has been adopted to permit and
establish such costs recoveries.
The provisions of this article shall apply to the violation of any Township
ordinance, including traffic and zoning offenses.
The Township shall have the right to apply to and receive from any court
of competent jurisdiction its reasonable costs of response to citation for,
arrest for, or prosecution of any Township ordinance violation. The recovery
of such costs may be had in any case, including dismissals upon payment of
costs.
Any violation prosecuted in court, including dismissals by the prosecution,
shall carry a minimum cost recovery in the amount of $25 unless otherwise
waived by the Township.
