This article may be known and referred to as the "Charter Township of Blackman Trash and Refuse Collection Ordinance."
The purpose of this article is to promote the public health, safety, and welfare within the Township of Blackman, County of Jackson, State of Michigan, by making provision for and to ensure the proper and adequate removal of trash and refuse within the Charter Township of Blackman.
Any person, firm, partnership, limited liability company, association, or corporation providing trash and refuse collection services within the Charter Township of Blackman shall do so only if granted a license by the Township Board as provided in this article.
Any person, firm, partnership, limited liability company, association, or corporation desiring to engage in the business of operating and conducting trash and refuse collection services within the Township of Blackman shall make application in writing to the Township Board for a license to engage in said business, which said applications will specify the names of the owners, partners, members, managers, and/or corporate officers. Such application shall also be accompanied by an annual license fee as determined by the Township Board.
No license fee shall be required of any political, charitable or religious establishment. The provisions of this article are not applicable to any agency of the United States of America, the State of Michigan, or any political subdivisions thereof.
The following requirements and regulations apply to trash and refuse collectors:
A. 
Proof of general liability insurance ($1,000,000 general aggregate).
B. 
Proof of vehicle insurance ($500,000 combined single limit).
C. 
Proof of workers' compensation coverage, if required (statutory).
D. 
All vehicles used for the purpose of garbage and refuse removal must be inspected and approved by an appropriate state or county agency, or otherwise be certified as safe to operate.
E. 
No collection vehicles shall operate before 6:00 a.m. or after 9:00 p.m. near any residential area.
The Charter Township of Blackman hereby designates the Township Ordinance Officer and/or the Public Safety Department as the enforcing agencies to discharge the responsibilities of the Township under this article.
In the event of any noncompliance with the provisions of this article after a license has been issued, the same may be revoked by order of the licensing agent until the noncompliance has been corrected as determined by said agent.

Any person who violates this article shall be guilty of a misdemeanor, punishable by a fine of not more than $500 or imprisonment in the county jail for a period not exceeding 90 days, or both fine and imprisonment.
