For the purposes of this chapter, the following terms shall have the meanings indicated:
Those lands fronting upon the bay, river, stream or upon any body of water, whether natural or man-made, in the Township of Egg Harbor.

Bathing and swimming from any public lands of the Township of Egg Harbor fronting upon the bay, river, stream or upon any body of water, whether natural or man-made, in the Township of Egg Harbor is prohibited, except that bathing and swimming shall be permissible upon those lands fronting upon the bay, river, stream or upon any body of water, whether natural or man-made, in the Township of Egg Harbor only in those publicly owned areas designated as bathing and swimming areas by the posting of signs and only during those hours and times of year that those publicly owned lands are patrolled and protected by lifeguards designated as such by the Township Committee of the Township of Egg Harbor.

Fishing, crabbing or netting along Bay Drive adjacent to Lakes Bay shall be prohibited between Lyons Court and Plaza Drive. Fishing, crabbing or netting from docks and/or boats is permitted.

No person shall climb upon or walk upon any gabion walls or dunes adjacent to Lakes Bay (along Bay Drive) between Florence Avenue and Brenta Avenue.

The Township Committee is hereby authorized and empowered to adopt, by resolution, in addition to the rules and regulations herein enumerated, such other rules and regulations as may be necessary for the proper control and regulation of the beachfront and waters adjacent thereto.
The following rules and regulations are hereby established, and it shall be unlawful to violate any of said rules and regulations or those subsequently adopted by resolution:
A.
No person shall bathe or swim from the beachfront beyond a safe depth.
B.
No person shall change clothes, dress, undress or otherwise disrobe except for outer wraps.
C.
No person shall act in a loud, indecent, obscene or offensive manner.
D.
No person shall revel, disport or behave in a noisy and boisterous manner, emitting loud cries and other noises, so as to inconvenience others, or otherwise disrupt and disturb the public peace and dignity within the beach areas defined or such adjacent areas.
E.
The starting or maintenance of a fire or fires on the beach at any time during the entire year is prohibited.

Violation of any provision of this chapter shall, upon conviction thereof, be punished by a minimum fine of $100 or a maximum of $2,000 or by imprisonment for a term not exceeding 90 days or by a period of community service not exceeding 90 days. Each and every violation shall be considered a separate violation. Any person who is convicted of violating the provisions of this chapter within one year of the date of a previous violation and who was fined for the previous violation may be sentenced by the Court to an additional fine as a repeat offender. The additional fine imposed as a repeat offender shall not be less than the minimum or exceed the maximum fine provided herein, and same shall be calculated separately from the fine imposed for the violation of this chapter.
