Certain words and phrases are used in this article which, for the purpose hereof, are defined as follows:
ASHES
The residue from the burning of wood, coal or other combustible materials.
BRUSH AND VEGETATIVE WASTE
All grass clippings, lawn thatching, leaves, bushes, limbs, branches and small trees up to four inches in diameter, with the stumps or root balls removed.
BUILDING MATERIALS
Includes all or any wastes from building construction.
COLLECTOR
Any person engaged in the business for gathering or disposing of garbage, refuse, waste material and building materials.
GARBAGE
Any animal or vegetable waste solids resulting from the handling, preparation, cooking or consumption of foods, but not including human wastes.
PAPER
Includes newspaper, periodicals, cardboard and all other wastepaper.
PERSON
An individual, proprietorship, partnership, limited partnership, corporation, association, municipality, county and state government or any political subdivision thereof or other legal entity.
REFUSE
Ashes, rubbish and trade waste.
RUBBISH AND TRASH
Nonrecyclable combustibles and noncombustible material.
STREET, CURB, SIDEWALK AND ALLEY
Any accepted public street, curb, sidewalk and alley.
TRADE WASTE
Includes but is not limited to all material resulting from the prosecution of any business, trade or industry and shall include but not be limited to paper, rags, leather, rubber, cartons, boxes, wood, excelsior, sawdust, garbage, metals, metal shavings, wire, tin cans, cylinders, earth and other materials, including building construction or alteration work.
WASTE MATERIAL
Includes all or any garbage, refuse, paper, trade waste and wastes from building construction or alteration work.
A. 
Any person engaged in the business of the collection or disposal of garbage, refuse, waste material and building material shall comply with all of the following requirements:
(1) 
Any truck used for the collection and transportation of garbage, refuse, waste material and building material shall have a body and be so protected on the top that no garbage, refuse, waste material or building material shall be blown or dropped from the truck. The garbage, refuse, waste material and building material carried in the truck shall be confined within its permanent body construction. Such trucks shall be kept covered at all times except during the period of filling or emptying.
(2) 
Any garbage, refuse, waste material or building material which is dropped or blown from the truck, either during collection or transportation or emptying, shall be swept or cleaned up immediately so as not to leave any such matter upon the public streets, curbs, sidewalks and alleys within the Township.
(3) 
All containers or receptacles emptied during the course of the collection of garbage, refuse, waste material and building material shall be returned to the locations from which they were removed during the course of collection.
B. 
In addition to compliance with the foregoing requirements, any person engaged in the collection or disposal of garbage, refuse, waste material and building material within the Township shall comply with all state statutes, codes and regulations and all municipal ordinances and regulations concerning the collection and the disposal of such materials. Any area used for the disposal of garbage, refuse, waste material and building material shall be maintained and operated in accordance with all applicable state statues, codes, regulations and municipal ordinances and regulations.
A. 
To ensure the effective operation of the provisions of this article, the Township Administrator is authorized to make such written rules and regulations as may be necessary or expedient to further implement the provisions of this article.
B. 
No person shall violate any written rules, regulation or order made by the Township Administrator pursuant to this article.
C. 
No rule and regulation so written by the Township Administrator shall be effective until it has been approved by a resolution of the Township Committee and published at least once in the newspaper in which Township ordinances are published.
A. 
Violation of any provision of this article shall, upon conviction thereof, be punished by a minimum fine of $100 or a maximum of $2,000 or by imprisonment for a term not exceeding 90 days or by a period of community service not exceeding 90 days. Each and every violation shall be considered a separate violation. Any person who is convicted of violating the provisions of this article within one year of the date of a previous violation and who was fined for the previous violation may be sentenced by the Court to an additional fine as a repeat offender. The additional fine imposed as a repeat offender shall not be less than the minimum or exceed the maximum fine provided herein, and same shall be calculated separately from the fine imposed for the violation of this article.

B. 
Separate violations. Except as otherwise provided, each day in which a violation of any provision of this article exists shall constitute a separate and distinct violation.
