B.
The Department shall also have the following administrative
responsibilities:
(1)
To establish standard procedures, including forms,
for the collection of license fees, issuance of licenses and referral
of inspections, investigations or enforcement to other agencies, departments
or divisions and for reporting disposition.
(2)
To recommend to the Council the adoption of ordinances
or the amendment of ordinances deemed required, including but not
limited to the adoption of appropriate state model codes regulating
building, building materials and building methods.
(3)
To administer and enforce and make inspections under
such other laws and ordinances in force and effect which establish
standards to protect the health and/or safety of persons using or
occupying buildings or other structures within the Township. The Department
shall not duplicate inspections required by ordinance to be made by
the Fire Department, but the results of such inspections by the Fire
Department shall be reported to the Construction Department for appropriate
action.
C.
Inspection and enforcement generally.
(1)
The Mayor or his designated representative shall receive
requests to conduct inspections and shall schedule and assign inspectors
to conduct said inspections.
(2)
The Mayor or his designated representative shall assign
inspectors to investigate and to report upon suspected violations
of ordinances or of laws protecting the public health and/or safety.
(3)
The Department shall conduct and administer such inspections
and enforcement proceedings as are authorized by law or by ordinance
and shall, insofar as practicable, consolidate and coordinate all
regulatory inspections relating to the construction, maintenance,
use and occupancy of buildings and structures which are not vested
in other departments, divisions or agencies by law or by this chapter.
(4)
Copies of building permits and other actions taken
by the Construction Department which may affect the public health
and/or safety shall be filed with the appropriate officials.
B.
Enforcing
Agency established; qualifications; office location; adoption of codes.

(1)
There is hereby established in the Township of Logan a Uniform Construction
Code enforcing agency to be known as the "Logan Township Uniform Construction
Code Enforcing Agency," consisting of the Construction Official, Building
Subcode Official, Plumbing Subcode Official, Electrical Subcode Official
and a Fire Protection Subcode Official, a Building Inspector, an Electrical
Inspector, a Plumbing Inspector and a Fire Protection Inspector and
such other subcode officials for such additional subcodes as the Commissioner
of the Department of Community Affairs, State of New Jersey, shall
hereafter adopt as a part of the State Uniform Construction Code.
The Construction Official shall be the chief administrator of the
Enforcing Agency.
(2)
Each official position created in Subsection B(1) hereof shall be filled by a person qualified for such position pursuant to P.L. 1975, c. 217, as amended,[1] and N.J.A.C. 5:23; provided that, in lieu of any particular
subcode official, an on-site inspection agency may be retained by
contract pursuant to N.J.A.C. 5:23. More than one official position
may at any time be held by the same person, provided that such person
shall be found to be qualified pursuant to P.L. 1975, c. 217, and
N.J.A.C. 5:23 to hold such position.

(3)
The public shall have the right to do business with the Enforcing
Agency at one office location, except for emergencies and unforeseen
or unavoidable circumstances.

Code. N.J.A.C. 5:23-1 et seq., the following codes, including all
subsequent revisions and amendments thereto, are hereby adopted by
reference as the Codes of the Township of Logan: International Building
Code, 2015 NJ edition; National Standard Plumbing Code, 2015 edition;
National Electrical Code, 2014 edition; International Energy Conservation
Code, 2015 edition; International Mechanical Code, 2015 edition; International
Residential Code, 2015 NJ edition; International Fuel Gas Code, 2015
edition; and International Fire Code, 2015 NJ edition; International
Swimming Pool and Spa Code, 2018 edition; International Existing Building
Code, 2018 edition; and International Property Maintenance Code, 2018
edition.
C.
Construction Board of Appeals. The Gloucester County
Construction Board of Appeals was established as the Logan Township
Board of Appeals pursuant to Resolution No. 60-1977, entitled "Resolution
Reestablishing the Intent of the Township Committee of the Township
of Logan to Establish the Gloucester County Board of Appeals as the
Logan Township Board of Appeals Under the Uniform Construction Code,"
which was adopted by the Township Committee of the Township of Logan
on December 14, 1977.
D.
Permit fees; annual report; surcharge fee.
(1)
The fee for a construction permit shall be the sum
of the subcode fees listed in (1) through (3) hereof and shall be
paid before any permit for construction shall be issued.[2]The subcode fees shall be waived for construction contracted
for or conducted by the Township of Logan within its boundaries.

(4) Fee for plan review.
(5) Fee for a permit to demolish a residential
structure.
(6) Fee for a permit to demolish a structure
other than a residential structure.
(7) Fee for a permit to remove a building
from one lot to another.
(8) Fee for a permit to construct a sign.
(9) Fee for a certificate of occupancy.
(10) Fee for a permit to install an elevator.
(11) Fee for inspection of an elevator.
(12) Miscellaneous fees for work not part
of a new construction.

The Construction Official shall, with the advice of
the subcode officials, prepare and submit to the Township of Logan,
annually, a report recommending a fee schedule based on the operating
expenses of the Agency and such other expenses of the municipality
as are fairly attributable to the enforcement of the State Uniform
Construction Code Act.[3]

State Training fee.
(a)
In order to provide for the training, certification
and technical support programs required by the Uniform Construction
Code Act and the regulations,[4]the Enforcing Agency shall collect, in addition to the
fees specified above, a fee set by the state per cubic foot of volume
of new construction. Said fee shall be remitted to the Department
of Community Affairs on a quarterly basis for the fiscal quarters
ending September 30, December 31, March 31 and June 30, and not later
than one month next succeeding the end of the quarter for which it
is due. In the fiscal year in which the regulations first become effective,
said fee shall be collected and remitted for the third and fourth
quarters only.

(b)
The Enforcing Agency shall report annually at the
end of each fiscal year to the Department of Community Affiars, and
not later than July 31, the total amount of the surcharge fee collected
in the fiscal year. In the fiscal year in which the regulations first
become effective, said report shall be for the third and fourth quarters
only.
E.
Fire limits.
(1)
Fire limits established. The fire limits delineated
in Article 3 of the BOCA Basic Building Code/1975 of the Building
Officials and Code Administrators International, Inc. are hereby established.
(2)
Extent of fire limits. The fire limits established
herein apply to all zoning districts within the Township of Logan
except those districts designated "residential."
The composition, powers and duties of the Division
of Land Use shall be as follows:
A.
Zoning Officer. This official shall administer and
enforce the Township Zoning Ordinance,[1] ordinances regulating signs and outdoor display structures
within the Township, conditions of Planning Board approval and compliance
with variances granted pursuant to the Township Zoning Ordinance,
subject to applicable law.

B.
Land Use Officer. This official shall administer all
Planning Board applications; prepare certified lists of property owners
and perform all other duties required of this office.
C.
The Zoning Officer and the Land Use Officer shall
be appointed by the Mayor with the advice and consent of Council for
a term of one year.
