Any vacancy occurring by reason of death, resignation or removal of
any member shall be filled for the unexpired term of the original appointee.
The scope, responsibilities and powers of the Shade Tree Committee shall
be as follows:
A. Exercise full and exclusive control over the regulation,
planting and care of shade and ornamental trees and shrubbery now located,
or which hereafter may be planted, in any public highway, park, parkway or
other public grounds, except in areas under state or county jurisdiction as
defined in N.J.S.A. 40:64-1 (cited for definitional purposes only).
B. Regulate and control the use of the ground surrounding
the same, so far as may be necessary for their proper growth, care and protection.
C. Move or require the removal of any tree, or part thereof,
dangerous to public safety.
D. Care for and control such parks and parkways.
F. Make recommendations to the Planning and/or Zoning Boards
as more particularly set out in this chapter.
The cost of the removal of any tree or part thereof dangerous to public
safety, as determined by the Shade Tree Committee, shall be a charge upon
the real estate where the tree is situated, if the owner thereof is given
written notice to remove such tree, and fails to do so within 10 days of receipt
of said notice. Said charge shall be due and payable to the Township Clerk.
The township governing body shall annually appropriate such moneys as
it may deem necessary for the purchase of trees and shrubbery and the purchase
of necessary equipment, services and materials.
