As used in this chapter, the following terms shall have the meanings indicated:
DUMPING
Placement of any form of bulk recyclable or bulk waste in unauthorized private or public receptacles for collection or upon any street, sidewalk, public or private property.
LITTER
Any form of rubbish, trash, garbage, brush, weeds, wood, filth, debris or recyclable materials not placed in public receptacles or in authorized private receptacles for collection.
PERSON
Any individual, firm, corporation, association, society, partnership or charity, and their servants or employees.
UNAUTHORIZED RECEPTACLE OR LANDFILL
A. 
Any privately owned/leased receptacle used by any person other than the owner, leasor, employee or agent of owner/leasor, without the express permission of the owner/leasor; any publicly owned/leased receptacle used by any person to dump bulk recyclables or bulk waste, without the express permission of the public entity owning/leasing said receptacle.
B. 
Any landfill not licensed by the New Jersey Department of Environmental Protection or any public or private property used for littering or dumping, with or without the property owner's permission.
No person shall throw, deposit or dump any litter or bulk material upon any street, sidewalk or other private or public place within the township, except in authorized public or private receptacles for collection. All material placed in an authorized receptacle shall be deposited in such a manner as to prevent it from being spilled, blown, carried or deposited upon any street, sidewalk, public or private property.
A. 
No person, while an operator or a passenger in any vehicle, shall throw, deposit, litter or dump upon any street, sidewalk, public or private property.
B. 
No person shall operate a vehicle which is not constructed, loaded or covered so as to prevent litter from being blown, deposited or dumped upon any street, sidewalk, public or private property.
A. 
No person shall throw or deposit litter in any public place in the township, except in authorized receptacles. Where authorized receptacles are not provided, the person responsible for the presence of the litter shall carry it away in order to properly dispose of it.
B. 
No person shall dump any bulk recyclables or bulk waste in any public place and shall not use any publicly owned/leased receptacle to dump bulk recyclables or bulk waste, without the express permission of the public entity owning/leasing said receptacle.
No person shall throw, deposit, litter or dump on any private property within the township whether owned by that person or not, except in authorized receptacles for collection. Compost materials and firewood shall be excluded from this section.
A. 
Any person who violates or neglects to comply with any provision of this chapter or any regulation promulgated pursuant thereto shall, upon conviction thereof, be subject to penalties as follows:
(1) 
First offense: minimum $50/maximum $250, perform cleanup or pay cleanup costs and/or up to five days of community service.
(2) 
Second offense: minimum $100/maximum $500, perform cleanup or pay cleanup costs and/or up to 10 days of community service.
(3) 
Third offense: minimum $250/maximum $1,000, perform cleanup or pay cleanup costs and/or up to 30 days of community service.
(4) 
Subsequent offenses: minimum $500/maximum $5,000, perform cleanup or pay cleanup costs and/or up to 60 days of community service and/or up to 90 days in jail.
B. 
Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such.
