It is hereby declared to be the policy of the Village Board of Trustees
to prevent unreasonably disturbing and unnecessary noise. It is the intention
of the Village Board of Trustees to reduce the noise level within the Village
of Morrisville so as to preserve, protect and promote the public health, safety
and welfare and to foster convenience, peace and quiet of the village by the
inhabitants and transients within the Village of Morrisville. The Village
Board finds that every person is entitled to have maintained noise levels
which are not detrimental to life, health and enjoyment of property, in that
excessive and unnecessary noise within the Village of Morrisville affects
and is a menace to the public health, safety and welfare and the comfort of
the people of the Village of Morrisville.
Any sound which crosses over a real property ownership boundary and
continues for such duration and at such a level as to offend the comfort,
repose, health, peace or safety of a reasonable person of normal sensitivities
shall constitute unreasonable noise.
No person owning, operating, occupying or having charge of any motor
vehicle, building or premises, or any part thereof, in the Village of Morrisville
shall cause, suffer or allow any unreasonable noise in the operation or use
of any such motor vehicle, radio, sound system or other mechanical or electrical
or sound-reproducing device, instrument or machine, whether located inside
or outside a motor vehicle or building. No person shall operate any motor
vehicle, snowmobile or all-terrain vehicle in such manner, or in such mechanical
state, as to produce any unreasonable noise, including, but not necessarily
limited to, unreasonable engine or exhaust noise or noise from the spinning
or squealing of tires. No person owning or harboring any dog shall allow such
dog to bark for such an extended period of time as to produce unreasonable
noise.
The provisions of this chapter shall not apply to any community parade,
picnic, field days or other event which is sponsored by the Village of Morrisville,
any volunteer fire company, the State University of New York and/or any civic
or religious organization or other nonprofit or neighborhood organization
recognized by the Board of Trustees.
No person shall operate a motor vehicle, lawn mower, leafblower, chain
saw or other landscaping equipment, or any internal combustion engine, without
a muffler properly maintained in accordance with the original design and manufacturing
specifications of the motor vehicle or equipment.
Any person found guilty of violating any of the provisions of this chapter
shall be subject to a fine not to exceed $250 or imprisonment not to exceed
15 days, or both such fine and imprisonment.
If any clause, sentence, paragraph, section or part of this chapter
shall be adjudged by any court of competent jurisdiction to be invalid, the
judgment shall not affect, impair or invalidate the remainder of this chapter,
but shall be directly involved in the controversy in which such judgment shall
have been rendered.
