It is the intent of the Town of Wallkill that all site plan and subdivision projects utilize the Town of Wallkill's permanent survey monuments. In furtherance of this objective, the Town of Wallkill has had permanent survey monuments installed at various locations throughout the town incorporating latitude, longitude and elevations based upon the North American Datum (NAD) and the corresponding New York State Plane Coordinate (NYSPC) System. This survey monumentation provides a proper and sound data base for the planning of future development in the town and for the engineering, construction and as-built drawings of site improvements, sanitary sewer lines, waterlines, storm drainage systems, road improvements and related.
All site development plans within the Town of Wallkill shall utilize the permanent town survey monuments for the site plan maps prepared in accordance with § 249-40E of the Town Code. Any reference in the Town Code to United States Geological Survey Datum shall now mean the North American Datum (NAD) and the New York State Plane Coordinate (NYSPC) System as established by the permanent town survey monuments. A developer must comply with the requirement of utilizing the town survey monuments in the development of site plan and subdivision maps, topography and proposed elevations of road, water, sewer, drainage and related improvements. All as-built drawings of on-site and off-site improvements must be based upon the town survey monuments.
A. 
The Planning Board shall require, as a condition to approval of any site plan or subdivision plat, a payment to the town of a survey monument fee, which fee shall be available for use by the town for the expense associated with the survey monument program and comprehensive as-built plans of site improvements throughout the town.
B. 
Determination of fee. For all site plans and subdivisions, the survey monument fee shall be determined per unit or lot. A unit or lot shall be computed as follows:

(1) 
Subdivision: one unit equals one approved subdivided lot.
(2) 
Multiple-family development: one unit equals each individual condominium, townhouse, apartment or dwelling unit approved.
(3) 
Industrial, commercial, office or other such use: one unit shall equal 2,000 square feet of building area approved.
C. 
Payment of fee. The total amount of survey monument fees required to be paid by the developer shall be delivered to the town at the time of final approval and prior to the signing of the site plan or subdivision plans by the Chairman of the Planning Board.
D. 
All fees required to be paid pursuant to this chapter shall be set by resolution of the Town Board.

A. 
This chapter shall be effective January 1, 1990.
B. 
All site plans and subdivisions receiving final approval after January 1, 1990, will be required to pay the survey monument fees set forth in this chapter. All site plans and subdivisions which received final approval before January 1, 1990, but have not submitted as-built drawings to the town, will not be required to pay a survey monument fee, but will be required to submit as-built drawings based on the town survey monuments.
