The provisions of this article shall apply to boats, personal watercraft, boating, and to any watercraft propelled by machinery used or capable of being used to stimulate water skiing without the aid of a separate towing boat on Lake El Reno.

A. 
There is hereby adopted by reference and made a part of the Code of Ordinances of the City of El Reno all of the provisions of Chapter 72 of the Oklahoma Boating Safety Regulation Act, as found in 63 O.S. §§ 4200 through 4236 and including any amendments thereto, and additionally including the adopting of any statute in said chapters which provides for discretionary adoption by a municipality. All of the provisions found in these chapters are hereby adopted and incorporated herein by reference, and are enforceable by the City within the City limits as fully as if set out at length herein.
B. 
In the event that any ordinance of the City shall conflict with Chapter 72 of the Oklahoma Boating Safety Regulation Act found in Title 63 of the Oklahoma Statutes, or any amendments thereto, then the provisions of Title 63 of the Oklahoma Statutes adopted herein shall be controlling.
C. 
In the event that penalties, incarcerations, fines, or costs imposed by Oklahoma Statutes are in excess of the limits allowed to be imposed by municipalities, then such penalties, incarcerations, fines, or costs allowable shall control.
D. 
In the event that a violation of the law under the Oklahoma Statutes constitutes a felony, then such a violation of the ordinances of the City shall constitute a misdemeanor rather than a felony.

Any operation involving the rental of private boats or personal watercraft for use on Lake El Reno shall require a special permit from the City with terms as set and approved by the City Council.
Rowboats shall have the right-of-way at all times over sailboats. Sailboats shall have the right-of-way at all times over motorboats and personal watercraft.
A. 
No person shall operate a boat or personal watercraft on the lake while under the influence or intoxicated by an alcoholic beverage as defined in § 275-1.
B. 
No person shall operate a boat or personal watercraft on the lake while under the influence or intoxicated by any substance included in the Uniform Controlled Dangerous Substances Act.[1]

The operator of a motor boat or personal watercraft shall, at all times, keep such boat or personal watercraft at a safe distance from other boats or vehicles.
A. 
"No-wake areas" are hereby established. These areas will be appropriately designated with the use of buoys and/or signs. Motorboats and personal watercraft shall move only at idling speed, less than five miles per hour.
B. 
Motorboats and personal watercraft shall be operated in any neck or bay only for the purpose of fishing and shall move only at idling speed, less than five miles per hour.
No person shall participate in any boat race, or in any race between a boat and a personal watercraft or between multiple personal watercraft, unless such race is specifically authorized by the City Council.
