Unless otherwise expressly stated, the following
terms shall have the meanings indicated:
ADULT BOOKSTORES
An establishment having more than 5% of its stock-in-trade
books, magazines, video tapes, video disks, video displays, films
for sale or viewing on premises by use of motion-picture devices or
any other coin-operated means and other periodicals which are distinguished
or characterized by their emphasis on matter depicting, describing
or relating to specified sexual activities or specified anatomical
areas, or an establishment with a segment or section devoted to the
sale or display of such material.
ADULT DAY CARE
A facility in which day care is provided for seven or more
senior citizens at any one time, where senior citizen care areas are
not being used as a family residence, and the facility meets all state
requirements, including licensing by the Commonwealth of Pennsylvania,
if required.
ADULT ENTERTAINMENT CABARET
A public or private establishment which is licensed to serve
food and/or alcoholic beverages, which features topless dancers, strippers,
male or female impersonators or similar entertainers.
ADULT MOTION-PICTURE THEATER
An enclosed building used regularly and routinely for presenting
material having as a dominant theme material distinguished or characterized
by an emphasis on matter depicting, describing or relating to specified
sexual activities or specified anatomical areas for observation by
patrons therein.
AGE-TARGETED HOUSING
A development of multiplex dwelling units and/or townhouses
designed to be attractive to (but not required to be restricted to)
older persons, with each unit having interior access to a garage;
being limited to no more than three bedrooms; and with all exterior
building surfaces, landscaping and parking facilities maintained by
a homeowners’ association.

AGRICULTURE
The cultivating of the soil, and the raising and harvesting
of the products from the soil, including, but not by way of limitation,
nursery, horticulture and forestry.
ALLEY
A strip of land over which there is a right-of-way, municipally
or privately owned, on which no dwellings or stores front, serving
as the secondary means of access to two or more properties.
ALTERATIONS
As applied to a building or structure, any change or rearrangement
in the total floor area, or any enlargement, whether by extending
on a side or rear or by increasing in height or by moving from one
location or position to another.
ALTERATIONS, CONVERSION
A multifamily dwelling constructed by converting an existing
dwelling into apartments for more than one family.
ALTERATIONS, STRUCTURAL
Any change in supporting members of a building such as bearing
walls, columns, beams or girders.
APARTMENT
A permanent dwelling unit within a building containing three
or more dwelling units (also known as “apartment house”),
each for a single family living independent of one another, and being
vertically arranged, sharing outside access, and having one or more
walls as well as a ceiling or floor in common with another dwelling
unit. (See also "multiple dwelling.")

ARTISANAL MANUFACTURING
The manufacture and production by a manual worker or craftsperson
of commercial goods, such as jewelry, metalwork, cabinetry, stained
glass, textiles, ceramics, or hand-made food products. Artisanal manufacturing
may include a retail component. Artisanal manufacturing does not include
any activity that causes noise, odor, or vibration to be detectable
on a neighboring property, and it is limited to 5,000 square feet
of gross floor area.

BAR, TAVERN or TAPROOM
An establishment primarily devoted to the serving of alcoholic
beverages by the drink and in which food service is incidental to
consumption of such beverage. This shall not include brewpubs or microbreweries.

BASE FLOOD
The flood which has been selected to serve as the basis upon
which the floodplain management provisions of this chapter and other
ordinances have been prepared; for purposes of this chapter, the one-hundred-year
flood, as referenced in the current Flood Insurance Study, Township
of East Norriton, prepared by the Federal Insurance Administration,
United States Department of Housing and Urban Development.
BASE FLOOD ELEVATION
The one-hundred-year-flood elevation, as referenced in the
Flood Insurance Study, East Norriton Township, prepared by the Federal
Insurance Administration, United States Department of Housing and
Urban Development. Within the approximated floodplain, the one-hundred-year-flood
elevation shall be established as a point on the boundary of the approximated
floodplain nearest to the construction site in question.
BASEMENT
A story partly underground but having 1/2 or more of its
height measured from floor to ceiling above the average level of the
adjoining ground.
BILLBOARD
A sign that directs attention to a business, commodity, service,
or entertainment conducted, sold, or offered at a location other than
the premises on which the billboard is located.

BREWPUB
A full-service or fast-casual restaurant where the sale and
production of alcoholic beverages is accessory to the consumption
of prepared food.

BUFFER AREA
A strip of required yard space adjacent to the boundary of
a property or district, not less in width than is designated in this
chapter, and on which is placed year-round shrubbery, hedges, evergreens
or other suitable plantings of sufficient height and density to constitute
an effective screen and give maximum protection and adequate screening
to an abutting property or district. The "buffer area" may include
a wall or fence or a solid wall or fence, provided that such wall
or fence shall be screened or constructed in such a manner that it
will not conflict with the character of the abutting district.
BUILDING
Any structure having enclosed walls and roof, permanently
located on the land. This definition shall be deemed to include a
mobile home which is properly and securely anchored in accordance
with industry standards.
BUILDING, ACCESSORY
A building subordinate to the principal building on the lot,
used for purposes customarily incidental to those of the principal
building and not to be used as a dwelling unit unless such building
was originally designed as a dwelling unit, as in conjunction with
an institution. Any portion of a principal building devoted or intended
to be devoted to an accessory use is not an accessory building.
BUILDING AREA
The aggregate of the maximum horizontal cross-sectional areas
of all buildings on a lot above the ground level, measured at the
greatest outside dimensions, excluding cornices, eaves, girders or
chimneys projecting not more than 18 inches, bay windows not extending
through more than one story and not projecting more than five feet,
steps and balconies.
BUILDING, PRINCIPAL
A building on which is conducted the principal use of the
lot on which it is situated.
BUILDING SETBACK LINE
The line which establishes the minimum depth of front yard
required by the particular zoning district as measured from the ultimate
right-of-way line between which line and the ultimate right-of-way
line of the street on which the lot abuts a building may not be erected.
CELLAR
A story partly underground and having more than 1/2 of its
clear height below the average level of the adjoining ground. A cellar
shall not be considered in determining the permissible number of stories,
nor shall it be used for dwelling purposes.
CLUB
A place where members of a fraternal, cultural or religious
organization hold meetings. Such use shall occur only within a building
and shall not include facilities for temporary or continuous rental
of rooms or dwelling units.
COMMON OPEN SPACE
A parcel or parcels of land or an area of water or a combination
of land and water within a development site and designed and intended
for the use or enjoyment of residents of a development, not including
streets, off-street parking areas and areas set aside for public facilities.
CONDITIONAL USE
A use which may be allowed or denied pursuant to express standards or criteria by the Township Board of Supervisors, in accordance with Article
XXI, after a public hearing and reviewing comments by the Township Planning Agency to occupy or use land and/or buildings or structures for specific purposes in accordance with this chapter when such use is not permitted by right. The burden of proving compliance with the express standards and criteria applicable shall be on the applicant. The Township Board of Supervisors may attach such reasonable conditions and safeguards, in addition to those expressed in this chapter, as it may deem necessary to implement the purposes of this chapter.
CONSTRUCTION
The construction, reconstruction, renovation, repair, extension,
expansion, alteration or relocation of a building or structure, including
the placement of mobile homes.
CONVALESCENT OR NURSING HOME
A building, except a hospital, used for the care, treatment
or lodging for three or more persons who are either infirm, senile,
afflicted or suffering from any chronic physical or mental disease,
illness or application.
CORNER LOT
A lot fronting on two or more streets at their junction,
said streets forming with each other an angle of 45° up to and
including 135°.
DAY-CARE
A service providing out-of-home care for up to 12 hours per
day for children under 16 years of age and/or senior citizens.
DAY-CARE CENTER
A facility in which day care is provided for seven or more
children or senior citizens at any one time, where the child and/or
senior citizen care areas are not being used as a family residence,
and the facility meets all state requirements, including licensing
by the Commonwealth of Pennsylvania, if required.
DECISION
Final adjudication of any board or other body granted jurisdiction
under any land use ordinance or other applicable law, either by reason
of the grant of exclusive jurisdiction or by reason of appeals from
determinations. All decisions shall be appealable to the Court of
Common Pleas of Montgomery County and the judicial district in which
East Norriton Township lies.
DETERMINATION
Final adjudication of any board or other body granted jurisdiction
under any land use ordinance or other applicable law, either by reason
of the grant of exclusive jurisdiction or by reason of appeals from
determinations. All decisions shall be appealable to the Court of
Common Pleas of Montgomery County and the judicial district in which
East Norriton Township lies.
DEVELOPMENT
Any man-made change to improved or unimproved real estate,
including but not limited to buildings or other structures, the placement
of mobile homes, streets and other paving, utilities, mining, dredging,
filling, grading, excavation or drilling operations.
DOMESTIC ANIMALS
Dogs, cats, rabbits, guinea pigs and such other nonagricultural
and noncommercial animals normally recognized as pets.
DUPLEX
An attached dwelling unit having a horizontal party wall
in common with another dwelling unit. The building is designed so
that the horizontal party wall separates two families.
DWELLING
A building designed for and occupied exclusively for residential
purposes, excluding hotels, rooming houses, tourist homes, institutional
homes, residential clubs, motor courts and the like, but including
the following:
A.
SINGLE-FAMILY DWELLINGA building designed for and occupied exclusively as a dwelling for one family. This shall include a mobile home.
C.
MULTIPLE DWELLINGA building not a single-family dwelling nor a two-family dwelling, designed for and occupied exclusively for dwelling purposes by three or more families living independently of one another; not a townhouse, but customarily called an "apartment house."
DWELLING UNIT
A building or portion thereof providing complete housekeeping
facilities for one family, including living, sleeping, cooking, eating
and sanitary facilities.
ENGINEER
A professional engineer licensed as such in the Commonwealth
of Pennsylvania, duly appointed as the engineer for a municipality,
planning agency or joint planning commission.
FAMILY
Any number of individuals related by blood or marriage, including
adopted children, foster children or minor children under the legal
custody of an adult, living together as a single nonprofit housekeeping
unit and doing their cooking on the premises on a single cooking facility;
including two gratuitous guests. Family shall exclude, however, occupants
of a club, fraternity house, lodge, residential club or rooming house.
Family shall be deemed to include unrelated persons with disabilities
living together as a functional family equivalent.

FAMILY DAY-CARE HOME
Any dwelling in which child day care is provided at any one
time to between four to six children who are not relatives of the
caregiver, and where such children do not reside at the family day-care
home, and where the child care areas are being used as a family residence,
and which the facility meets all state requirements, including registration
or licensing where required by the Commonwealth of Pennsylvania.
FENCE, OPEN
An open fence shall be a minimum of 40% transparent as measured
from the top rail or top of board to the bottom rail or bottom of
board of the fence.

FLOOD
A temporary condition of partial or complete inundation of
normally dry land areas.
FLOOR AREA
The sum of the gross horizontal areas of all floors in a
building measured from the exterior face of the exterior walls or
from the center line of a wall separating two buildings, but not including
interior parking spaces, loading space for motor vehicles, stairwells
and elevator shafts or any area where the floor-to-ceiling height
is less than six feet.
FORESTRY
The management of forests and timberlands when practiced
in accordance with accepted silvicultural principles, through developing,
cultivating, harvesting, transporting and selling trees for commercial
purposes, which does not involve any land development.
FUND-RAISING ACTIVITY
Any activity, excluding volume retail sales, conducted in
an IN Institutional District whose profits are used to benefit the
institution. "Fund-raising activities" include but are not limited
to fairs, carnivals, flea markets, meals, games, rides and athletic
events.
GARAGE
A.
GARAGE, PRIVATEA building accessory to or an integral part of a single-family or two-family dwelling, for the storage of one or more motor vehicles owned and used by the owner or tenant or member of their household. Not more than one commercial vehicle or truck of a gross vehicle weight which does not exceed 9,000 pounds may be stored in a private garage.
B.
GARAGE, PUBLICA building, other than a private or storage garage, one or more stories in height, used solely for the commercial storage, service or repair of motor vehicles.
C.
GARAGE, STORAGEA building, not a public or private garage, one story in height, used solely for the storage of motor vehicles (other than trucks) but not for the service or repair thereof nor for the sale of fuel, accessories or supplies.
GASOLINE FILLING STATION
An area of land used for the retail sale of gasoline or other
motor vehicle fuel in combination with a food store that provides
a mix of packaged and freshly prepared foods and where seating for
up to 16 patrons or four tables may be permitted.

GREEN AREA
Land composed of pervious surfaces set aside for the growing
of vegetation, including lawn area, trees, shrubs, grasses, plants,
flowers and also including lakes, ponds, streams and other natural
features.
GROUP DAY-CARE HOME
A facility in which care is provided for more than six but
fewer than 12 children, at any one time, where the child-care areas
are being used as a family residence, and which the facility meets
all state requirements, including licensing by the Commonwealth of
Pennsylvania, where required.
GROUP HOME
A residential facility used as living quarters by any number
of unrelated persons requiring special care, specifically designed
to create a residential setting for the mentally and physically handicapped.
The individuals may be either transient or permanent residents. Any
number of handicapped persons, as defined in Title VIII of the Civil
Rights Act of 1968, as amended by the Fair Housing Amendments Act
of 1988, have the right to occupy a dwelling unit in the same manner
and to the same extent as any family unit.

HEIGHT OF BUILDING
A building’s vertical measurement from the mean level
of the ground surrounding the building to a point midway between the
highest and lowest points of the roof, provided that chimneys, spires,
towers, elevator penthouses, tanks, pentwall and similar projections
shall not be included in calculating the height; provided that these
projections shall not extend more than 15 feet above the maximum height
established for the district in which located.

HELIPAD
An area designated for the takeoff and landing of helicopters
that does not include ancillary services such as crew quarters, maintenance,
repair, parking and fueling services for helicopters.

HOME OCCUPATION
An occupation for gain or support conducted only by individuals
residing on the premises and conducted entirely within the dwelling,
provided that no article is sold or offered for sale except such as
may be produced on the premises. Retail sales are prohibited. Anyone
wishing to pursue a home occupation within the Township must first
apply for and obtain a permit from the Township Zoning Officer, who
shall issue such permit upon a showing of compliance with the provisions
of this chapter. Such permit must be renewed annually by the applicant.
The number of employees who are not residents of the dwelling is limited
to two. No more than 25% of the total floor area of the residence
may be used for the operation of the home occupation, including storage
area. Outdoor storage or display of goods is prohibited. Day care
for up to three unrelated children, not subject to space limitation,
when provided only by residents of the dwelling, shall be considered
a home occupation. Each dwelling shall be considered a home occupation.
Each dwelling or residential lot shall be limited to not more than
one home occupation. The conducting of a clinic, hospital, barbershop,
beauty parlor, tearoom, tourist home, animal hospital or real estate
office shall not be deemed to be a home occupation.
HOTEL
A facility offering furnished, transient lodging accommodations
to the general public and providing additional services, such as restaurants,
meeting rooms, banquet facilities and recreation facilities, with
pedestrian access for at least 90% of all rooms having to pass through
a main lobby. A hotel does not include a motel or convention center.
INSTITUTION
Any church, school, hospital or other non-profit-making organization.
JUNKYARD
A lot, land or structure, or plot thereof, used primarily
for the collection, storage or sale of wastepaper, rags, scrap metal
or discarded materials or for the collection, dismantling, storage
and salvaging of material or vehicles not in running condition and
for the potential sale or sales of parts thereof.
LOADING SPACE
A space, accessible from a street or way, in a building or
on a lot, for the temporary use of vehicles while loading or unloading
merchandise or materials.
LOT
A designated parcel, tract or area of land established by
a plat or otherwise as permitted by law and to be used, developed
or built upon as a unit.
LOT AREA
The area contained within the property lines of the individual
parcels of land as shown on a subdivision or development plan, excluding
any area within any right-of-way, but including the area of an easement.
LOT AREA, NET
Lot area excluding the following: area continuously covered
by water, areas contained within the one-hundred-year floodplain,
areas contained within regulated wetlands, areas contained within
steep slopes in excess of 15%, areas used for permanent stormwater
management facilities having a temporary storage elevation greater
than 1 1/2 feet, areas contained within overhead utility lines
and 50% of areas contained within underground utility easements, and
the area contained within the access leg of a flag or rear lot.
LOT LINE
A property boundary line of any lot held in single and separate
ownership, except that in the case of any lot abutting a street or
alley the lot line for such portion of the lot as abuts the street
shall be deemed to be the same as the street line and shall not be
the center line of the street or any other line within the street
even though such may be the property boundary line.
MASSAGE PARLORS
A commercial establishment in which the principal use consists
of massage or bodywork conducted by persons other than massage therapists,
and may include nude human modeling.

MASSAGE THERAPIST
A person holding a valid massage license issued by the Commonwealth
of Pennsylvania or, absent such licensing procedure, satisfying either
of the following criteria:

A.
Has graduated from a school licensed by the Commonwealth of
Pennsylvania, or by another state of the United States, which requires
at least 500 hours of education in massage or bodywork techniques,
anatomy and physiology, and who is a member of a nationally recognized
professional organization for massage or bodywork therapists that
adheres to a code of ethics; or
B.
Holds current and valid certification from the National Certification
Board of Therapeutic Massage and Bodywork (NCBTMB).
MASSAGE THERAPIST BUSINESS
A commercial establishment in which the principal use consists
of massage or bodywork conducted solely by massage therapists.

MEDIATION
A voluntary negotiating process in which parties in a dispute
mutually select a neutral mediator to assist them in jointly exploring
and settling their differences, culminating in a written agreement
which the parties themselves create and consider acceptable.
MICROBREWERY
A facility that produces malt or brewed alcoholic beverages
with another facility that offers said malt or brewed alcoholic beverages
for sale or consumption on the same or adjoining premises. Such uses
may also serve food items and must be licensed by the Pennsylvania
Liquor Control Board. This term may include nanobreweries, microdistilleries,
and wineries.

MINERAL EXTRACTION
The extraction of any aggregate or mass of mineral matter,
whether or not coherent. The term includes, but is not limited to,
quarrying, limestone and dolomite, sand and gravel, rock and stone,
earth, fill, slag, iron ore, zinc ore, vermiculite and clay, anthracite
and bituminous coal, coal refuse, peat and crude oil and natural gas.
MINING
The extraction of minerals and coal from the subsurface of
grounds located within the Township and shall not include quarrying
or open-face mining.
MOBILE HOME
A transportable, single-family dwelling intended for permanent
occupancy, contained in one unit or in two or more units designed
to be joined into one integral unit capable of again being separated
for repeated towing, which arrives at a site complete and ready for
occupancy except for minor and incidental unpacking and assembly operations,
and constructed so that it may be used without a permanent foundation.
MOBILE HOME PARK
A parcel or contiguous parcels of land which has been so
designated and improved that it contains two or more mobile home lots
for the placement thereon of mobile homes.
MOTOR COURT or MOTEL
A building or group of two or more detached or semidetached
buildings containing rooms or apartments having separate ground-floor
entrances provided directly or closely in connection with automobile
parking or storage space serving such rooms or apartments, which building
or group of buildings is designed, intended or used principally for
the providing of sleeping accommodations for automobile travelers
and is suitable for occupancy at all seasons of the year.
MULTIPLEX
An attached dwelling unit having horizontal and/or vertical
party walls in common with other dwelling units. In general all units
have independent outside access, but this is not necessary. Units
may be arranged in a variety of configurations: side by side, back
to back or vertically. Because of the variety of unit configurations,
a multiplex can be designed to look like a large single-family detached
house; this feature is encouraged. No fewer than three nor more than
six units shall be attached in any group. Individual dwelling units
may be one story or two stories, but in no case shall any portion
of the multiplex building exceed two stories exclusive of basement.
NO-IMPACT HOME-BASED BUSINESS
A business or commercial activity administered or conducted
as an accessory use which is clearly secondary to the use as a residential
dwelling and which involves no customer, client or patient traffic,
whether vehicular or pedestrian, pickup, delivery or removal functions
to or from the premises, in excess of those normally associated with
residential use. The business or commercial activity must satisfy
the following requirements:
A.
The business activity shall be compatible with
the residential use of the property and surrounding residential uses.
B.
The business shall employ no employees other
than family members residing in the dwelling.
C.
There shall be no display or sale of retail
goods and no stockpiling or inventory of a substantial nature.
D.
There shall be no outside appearance of a business
use, including, but not limited to, parking, signs or lights.
E.
The business activity may not use any equipment
or process which creates noise, vibration, glare, fumes, odors or
electrical or electronic interference, including interference with
radio or television reception, which is detectable in the neighborhood.
F.
The business activity may not generate any solid
waste or sewage discharge in volume or type which is not normally
associated with residential use in the neighborhood.
G.
The business activity shall be conducted only
within the dwelling and may not occupy more than 25% of the habitable
floor area.
H.
The business may not involve any illegal activity.
NONCONFORMING LOT
A lot the area or dimension of which was lawful prior to
the adoption or amendment of a zoning ordinance, but which fails to
conform to the requirements of the zoning district in which it is
located by reason of such adoption or amendment.
NONCONFORMING STRUCTURE
A structure or part of a structure manifestly not designed
to comply with the applicable use or extent of use provisions in a
zoning ordinance or amendment heretofore or hereafter enacted, where
such structure lawfully existed prior to the enactment of such ordinance
or amendment or prior to the application of such ordinance or amendment
to its location by reason of annexation. Such nonconforming structures
include but are not limited to nonconforming signs.
NONCONFORMING USE
A use, whether of land or of structure, which does not comply
with the applicable use provisions in a zoning ordinance or amendment
heretofore or hereafter enacted, where such use was lawfully in existence
prior to the enactment of such ordinance or amendment, or prior to
the application of such ordinance or amendment to its location by
reason of annexation.
ONE-HUNDRED-YEAR FLOOD
A flood that has one chance in 100 or a one-percent chance
of being equaled or exceeded in any given year. For the purposes of
this chapter, the one-hundred-year flood (base flood), as defined
by the Federal Insurance Administration, United States Department
of Housing and Urban Development, in the Flood Insurance Study, East
Norriton Township.
OUTDOOR DINING AREA
A designated area on the premises of a restaurant, but outside
the principal building, and where patrons may sit at tables while
consuming food and beverages ordered from and served by a waiter or
waitress.

OUTDOOR EATING AREA
A designated area on the premises of a retail food establishment,
but outside the principal building, and where patrons may sit at tables
while consuming foods, soft drinks, ice cream, and similar confections
purchased from the retail food establishment.

OUTDOOR FOOD SERVICE
An outdoor area on the premises of a restaurant or retail
food establishment where patrons may sit at tables to consume food
and beverages. Outdoor food service is classified as either "outdoor
dining" or "outdoor eating" areas.

OUTSIDE VENDOR
A person or group of people offering goods or services for
sale at a profit, who is not currently licensed to operate in East
Norriton Township.
PARKING SPACE, ALL-WEATHER
A parking space surfaced to whatever extent necessary to
permit reasonable use under all conditions of weather.
PERSON
A natural person, heirs, executors, administrators or assigns,
and includes a firm, partnership or corporation, or limited liability
corporation, its or their successors or assigns, or the agent of any
of the aforesaid.
PERSONAL CARE HOME
Any premises, licensed by the Commonwealth of Pennsylvania,
in which food, shelter and personal assistance or supervision are
provided for a period exceeding 24 hours for four or more senior citizens
who are not relatives of the operator, who do not require the services
in or of a licensed long-term care facility but who do require assistance
or supervision in such matters as dressing, bathing, diet, financial
management, evacuation of a residence in the event of an emergency
or medication prescribed for self-administration. Also known as "assisted
living."
PRINCIPAL ARTERIAL STREET
Roads identified as "principal arterial" in the Township-wide
Traffic Study, prepared for East Norriton Township by Valley Forge
Laboratories, Figure 2, pages 2 through 8, which is incorporated herein
by reference and is available for inspection at the municipal offices

PUBLIC HEARING
A formal meeting held pursuant to public notice by the Board
of Supervisors or the Planning Commission, intended to inform and
obtain public comment, prior to taking action in accordance with the
Subdivision and Land Development Ordinance and the Pennsylvania Municipalities
Planning Code (P.L. 805, No. 247, as amended).
PUBLIC NOTICE
Notice published once every week for two successive weeks
in a newspaper of general circulation in East Norriton Township. Such
notice shall state the time and place of the hearing and the particular
nature of the matter to be considered at the hearing. The first publication
shall not be more than 30 days and the second publication shall not
be less than seven days from the date of the hearing.
PUBLIC/PRIVATE UTILITY FACILITY
A building or structure and its equipment used for the transmission
and exchange of electricity, gas, heat, steam, transportation, water,
sewage collection or other similar service; provided, however, that
in a residential district, these shall not include business facilities,
storage of materials, truck or repair facilities or housing of repair
crews.

PUBLIC UTILITIES FACILITY
A building or structure and its equipment used for the transmission and exchange of telephone, radio, telephone, gas, power, sewer and water facilities; provided, however, that in a residential district, these shall not include business facilities, storage of materials, trucks or repair facilities or housing of repair crews. This definition shall not include wireless telecommunications facilities, as defined in Article
XXIX of this chapter.

PUBLIC UTILITY OFFICE
Offices for administration, executive, business, professional,
sales and other similar uses which do not involve the actual storage
of materials, trucks or repair facilities or housing of repair crews
on the premises.
RESTAURANT
Any establishment, however qualified in the subsequent defined
terms of this use, at which a principal use is to sell prepared food/beverages
to the general public for consumption on and off the premises.

RESTAURANT, FAST-FOOD
A restaurant where customers may place their food/beverage
orders by phone, online, at a counter inside the facility, or from
the customer's vehicle outside the facility by use of drive-through
or drive-in service. Food is often pre-prepared and is predominantly
served in disposable wrappings or containers. A fast-food restaurant
may have take-out food service.

RESTAURANT, FAST-CASUAL
A restaurant where customers place their orders by telephone,
online, or at a counter, and either the customer takes the food/beverage
to a table, booth, or counter or wait staff serves the food/beverage
at the customer's table, booth, or counter. Food is typically custom
prepared and generally served in disposable wrappings or containers.
A fast-casual restaurant may have take-out food service. Up to two
parking spaces may be restricted for limited drive-in service when
the parking spaces dedicated to this use are surplus to the number
of parking spaces otherwise required for the site.

RESTAURANT, FULL-SERVICE
A restaurant that provides full wait staff service where
food/beverages are ordered, served, and consumed by the customer normally
while seated at a table, booth, or counter. Food is predominantly
served with nondisposable dinnerware and flatware. A full-service
restaurant may include a brewpub. A full service restaurant may provide
limited take-out food service. Up to four parking spaces may be restricted
for limited drive-in service when the parking spaces dedicated to
this use are surplus to the number of parking spaces otherwise required
for the site.

SIGN
Any name, nameplate, billboard, poster, panel, display, illumination,
structure or other device used for visual communication, which is
affixed, painted or represented directly or indirectly upon a building
or other outdoor surface for the purpose of bringing the subject thereto
to the attention of the public or advertising a business, commodity,
service or products or for identifying a business, structure or use
of land.
SPECIAL OUTDOOR EVENT
A temporary outdoor use that extends beyond the normal uses
allowed within the district and subject to a special use permit that
may be issued by the Zoning Officer. Special outdoor events are limited
to lawful retail sales, art shows, car shows, sidewalk sales, Christmas
tree sales, carnivals, grand openings, festivals and customary activities
generally associated with the property where the special outdoor event
is to be located.

SPECIFIED ANATOMICAL AREAS
A.
Less than completely and opaquely covered human
genitals, pubic region, buttock and female breast below a point immediately
above the top of the areola.
B.
Human male genitals in a discernibly turgid
state, even if completely and opaquely covered.
SPECIFIED SEXUAL ACTIVITIES
A.
Human genitals in a state of sexual stimulation
or arousal.
B.
Acts of human masturbation, sexual intercourse
or sodomy.
C.
Fondling or other erotic touching of human genitals,
pubic region, buttock or female breast.
STORY
That portion of a building, including parking facilities,
included within the surface of any floor and the surface of the floor
next above it, or, if there is not floor above it, then the space
between the floor and the ceiling next above.
STREET
A strip of land, including the entire ultimate right-of-way,
publicly or privately owned, serving primarily as a means of vehicular
and pedestrian travel, furnishing access to abutting properties, which
may also be used to provide space for sewers, public utilities, shade
trees and sidewalks.
STREET LINE
The dividing line between the street and the lot. The street
line shall be the same as a legal right-of-way, provided that the
street right-of-way line shall not be less than 25 feet from the center
line of any road or street, and where a future right-of-way width
for a road or street has been officially established, the street right-of-way
line shall be the side line of the future right-of-way so established.
STRUCTURE
Any man-made object having an ascertainable stationery location
on or in land or water, whether or not affixed to the land.
TEMPORARY STRUCTURE
A combination of materials assembled, constructed or erected,
the use of which does not require attachment to the ground or attachment
to something having location on the ground. No structure containing
more than 168 square feet shall be considered a temporary structure.

TOURIST HOME
A dwelling in which sleeping accommodations for fewer than
10 persons are provided or offered primarily for automobile travelers
for compensation.
TOWNHOUSE
A single-family attached dwelling unit, with one dwelling
unit from ground to roof, having individual outside access both from
front and rear. The dwelling unit has a vertical party wall in common
with one or two of the other dwelling units in the series adjacent
to it and has no more than two floors exclusive of basement. No fewer
than three nor more than eight units shall be attached in any group.
TRIPLEX
An attached dwelling unit having a vertical party wall in
common with another dwelling unit. The building is designed so that
the vertical party wall separates three families.
TWIN HOUSE
A single-family, semidetached dwelling unit having only one
dwelling unit from ground to roof and only one party wall in common
with another dwelling unit. Each dwelling unit has no more than two
floors exclusive of basement. The building is designed so that a vertical
party wall separates two families.
USE
The specific purpose for which land or a building is designed,
arranged, intended or for which it is or may be occupied or maintained.
The term "permitted use" or its equivalent shall not be deemed to
include any nonconforming use.
USE, ACCESSORY
A use located on the same lot with a principal use and clearly
incidental or subordinate to and customarily in connection with the
principal use.
VOLUME RETAIL SALES
Total goods, new or used, offered for sale, having a fair
market value over $1,500 or fair market value over $500 from one source
or for one item.
YARD
An open, unoccupied space on the same lot with a building
or other structure or use, open and unobstructed from the ground to
the sky.
YARD, FRONT
A yard between a structure and a street line and extending
the entire length of the street line. In the case of a corner lot,
the yards extending along all streets are front yards, and among the
yards other than those defined as front yards shall include a rear
yard opposite the street to which the principal building is generally
faced and a side yard opposite the street. In the case of a lot other
than a corner lot that fronts on more than one street, the yards extending
along all streets are front yards.
YARD, REAR
A yard extending the full width of the lot along the rear
lot line and extending in depth from the rear lot line to the nearest
point of any structure on the lot.
YARD, SIDE
A yard extending the full depth of the lot along a side lot
line and extending in width from such side lot line to the nearest
point of any structure on the lot.
