A. For the purpose of taxation, the Tax Assessor is hereby authorized
to grant a reduction of $49,825 on the real property valuation for
property which is occupied by at least one owner, or one principal,
shareholder or member of the owner, if said owner is a corporation,
limited-liability company or other legal entity recognized under the
laws of the State of Rhode Island, and which is individually listed
or a contributing structure in a National Register of Historic Places
and is listed on the City of Pawtucket's local historic district or
is individually listed as a local historic district. Such exemption
shall be granted upon due evidence that he or she is so entitled.
This exemption shall not include individual condominium units within
qualifying structures.
B. In addition to meeting all of the requirements in Subsection
A of this section, to be entitled to this exemption, each year, beginning with taxes due in July 2014, property owners must:
(1) Maintain their properties to be in compliance with all of the state
building and housing codes and all municipal codes. For purposes of
this section, property owners who correct any violations of said codes
within the time frames allowed in said codes shall be deemed to be
in compliance with this requirement;
(2) Ensure that all construction, alterations, repairs, removals or demolitions affecting the exterior appearance of structures on their properties are done in compliance with Article
V (Historic Districts) of Chapter
410 of the Pawtucket Code of Ordinances, entitled. Zoning.
C. To determine if property owners are entitled to this exemption, each year, beginning with taxes due in July 2014, the Department of Planning and Redevelopment, hereinafter known as the "Department," working with other divisions of City government they deem necessary, shall annually review all properties in Pawtucket receiving the exemption. Properties not in compliance with Subsection
B of this section shall not be certified by the Department as eligible for the exemption for that near.
D. Any property owner not certified as eligible for this exemption in
any year shall be notified, in writing, by the Department. Any property
owner so notified may, within 30 days of the date of the notice, file
an appeal of the decision of the Department with the Pawtucket Zoning
Board of Appeals.
E. Upon passage of this section, the Department shall develop a tracking/monitoring
system to assist with the annual review of properties. The Department
shall also update the Historic District Commission webpage, send out
a mailing to current Historic District properties and modify relevant
applications to clearly indicate the new set of requirements.
The exemption authorized in §
363-59 hereof shall be in addition to any other exemption provided by law.
