The owner or tenant of any lands within the
Borough, where it shall be necessary and expedient for the preservation
of the public health, safety, general welfare or elimination of fire
hazards, shall remove brush, weeds, dead and dying trees, stumps,
roots, overhanging limbs, obnoxious growths, filth, garbage, trash
and debris from such land within 10 days after notice has been given
to the owner or tenant.
Should the owner or tenant refuse or neglect to remove the growths and material mentioned and described in §
286-1 in the manner and within the time mentioned above, the Borough, under the direction of the Code Enforcement Officer, may remove the same.
In the even that the material shall be removed
by or under the direction of a Code Enforcement Officer, such Code
Enforcement Officer shall certify the cost thereof to the Borough
Council, who shall examine the certificate and, if found correct,
shall cause the cost as shown thereon to be charged against the lands,
and the amount so charged shall forthwith become a lien upon such
lands and shall be added to and become and form part of the taxes
next to be assessed and levied upon such lands and to bear interest
at the same rate as taxes and be collected and enforced by the same
officers and in the same manner as taxes, all as provided by the provisions
of the statutes of the Sate of New Jersey in such case made and provided.
The owner of any lot of land on which underbrush,
bushes or wild grass accumulates shall on or before June 1 annually
cause the lot to be cleared and all underbrush, bushes and wild grass
to be removed from the lot.
Every person, firm, association, organization or corporation violating any provisions of this article shall, upon conviction, be liable to the penalty stated in Chapter
1, Article
II, General Penalty.
