No person shall encumber or obstruct any street or other public place in the Borough of Spring Lake by placing therein or thereon any building materials or any article or thing whatsoever without having first obtained the written permission of the Code Enforcement Officer under the penalty, upon conviction, as cited in § 330-51.

The Borough Superintendent, the Police Department or Code Enforcement Officer is hereby authorized and empowered to order any article or thing whatsoever which may encumber any street or other public place to be removed and, if such article or thing shall not be removed within two hours after notice to the owner thereof to remove the same or if the owner cannot be readily found for the purpose of such notice, to cause the same to be removed to some suitable place to be designated by the Borough Superintendent, Police Department or the Code Enforcement Officer. The owner of any article or thing so removed shall be liable, upon conviction, to the penalty established in § 330-51.
Any article or thing which may be removed in accordance with the provisions § 330-34 shall be advertised and sold by the Borough Superintendent at the end of 30 days after such removal unless the same shall be sooner reclaimed and the penalty and costs paid by the owner thereof; and the Borough Superintendent making such sale shall immediately thereafter pay the proceeds to the Borough Collector and furnish him with a statement of the article or thing sold, and the amount for which the same was sold; and the balance, if any, after deducting the penalty and costs shall be paid to the person or persons furnishing satisfactory proof of ownership.
No person shall remove or cause to be removed or aid or assist in removing any building into, along or across any street or public place in the Borough without having first obtained written permission of the Borough Superintendent and conforming to such restrictions and conditions as he may prescribe, and upon receiving such permit shall pay to the Borough Superintendent the sum of $50, which shall be refunded to such person when he or she has complied with the conditions imposed by such Borough Superintendent and has restored the street and public places in the Borough over which such building shall have been removed to their former condition.

Every such permit granted by the Borough Superintendent shall specify the time to be occupied in such removal, which time shall in no case be longer than is actually necessary, but such time may be extended for good and sufficient cause.
The owner of any building or the contractor for its removal, either or both, who shall suffer the same to be or remain in or upon any street or public place for any time longer than that specified in the permit issued by the Borough Superintendent, shall be liable to the penalty, upon conviction, stated in § 330-51 for every day the same shall continue.
No person shall erect, construct or maintain any building or part of a building, stoop, step, platform, show window, bay window, cellar door, open area, shed, post, pole, fence, gate, railing, sign or any other obstruction made or composed of any material whatever upon any street or other public ground within this Borough under the penalty as established in § 330-51.
The owner of any building, fence or other obstruction or encroachment now standing or which may hereafter be erected or placed upon any street or other public place within this Borough shall remove the same within 30 days from and after the time when he shall be required to remove the same by a notice in writing signed by the Borough Superintendent, under the penalty as established in § 330-51.
The owner of any posts, poles or other support placed in any of the public streets of the Borough for stringing wires thereon, or for any other purpose, which are not in use or are abandoned, shall remove the same within 10 days from and after the time when he, they or it shall be so required by a notice in writing signed by the Borough Superintendent under the penalty as established in § 330-51.
Whenever the owner of any building, fence or other encroachment or obstruction upon any street or other public ground within this Borough shall refuse or neglect to remove the same after notice as provided in §§ 330-40 and 330-41, the same shall be deemed a nuisance, and the Borough Superintendent is hereby authorized and directed to cause the same to be taken out, removed and abated, and the expense thereof shall be recoverable of the owner thereof, any every person who shall oppose or resist the Borough Superintendent in the premises shall forfeit and pay the sum of $50.

The owner or occupant of any house or other residential building shall not hang or erect or permit or suffer any sign, show bill or other thing to be hung or erected which shall project into or over the sidewalk in front of and from the wall of any such residential building. Any person who violates this section shall, upon conviction, be liable to the penalty established in § 330-51. Nothing in this section shall be construed to conflict with the provisions of § 225-25H(4).
All ornamental or shade street trees shall be placed or set out in accordance with the provisions of Chapter 356, Trees, Article I, Tree Removal and Protection. Placement of deciduous street trees shall be in the area between the improved vehicular roadway and the near edge of the sidewalk, or, in the event there is no sidewalk, they shall be placed between the improved vehicular roadway and the property line. Any person placing or causing to be placed any tree contrary to the provisions of Chapter 356, Article I, shall be liable, upon conviction, to the penalty established in § 330-51 for every week such tree shall be permitted to remain after notice shall have been given by the Code Enforcement Officer or by the Borough Superintendent to remove the same.
No person except the owner shall cut down, destroy, break or in any manner injure any tree or shrub standing in any public street unless by the direction of the Council or Borough Superintendent for the purpose of regulating and improving such street, under the penalty as established in § 330-51 and such owner or owners shall within 15 days, after notice by the Borough Superintendent, trim such trees to such height as he may consider necessary.
No person shall at any time fasten any animal to any ornamental or shade tree in any of the streets of this Borough or to any box or case around such tree without consent of the owner of such tree, under the penalty established in § 330-51.

No person shall obstruct the crosswalks laid across the public streets by placing or stopping his vehicle upon or across any of the crosswalks or by placing or putting any obstruction or thing across or on the same, under the penalty as established in § 330-51.

No person shall drive any vehicle over or upon any sidewalk unless it be in crossing the same to go into a yard or lot, under the penalty established in § 330-51.

No owner or occupant of any dwelling house, store or other building shall suffer or permit any vehicle to be driven or otherwise to pass or go over or upon the sidewalk in front of such building for the purpose of loading or unloading such vehicle or for any other purpose whatever, under the penalty established in § 330-51 for each offense.

If any cartman or other person shall break or otherwise injure any sidewalk in the Borough, he shall cause the same to be sufficiently repaired within 48 hours thereafter, under the penalty as established in Chapter I, Section 1-5.[1]

Every person, firm, association, organization or corporation violating any provisions of this article shall, upon conviction, be liable to the penalty stated in Chapter 1, Article II, General Penalty.
