The Zoning Officer is charged with the primary duty of enforcement of this chapter. Any resident of the Borough may bring a proceeding in Municipal Court alleging a violation of this chapter, including nonpayment of fees, escrows, inspection fees or other costs. This chapter may also be enforced by the Borough Manager by instituting a proceeding in the Municipal Court alleging a violation of this chapter.
A. 
Any owner or agent and any person or corporation who shall violate any of the provisions of this chapter or fail to comply therewith or with any of the requirements thereof or who shall erect, structurally alter, enlarge, rebuild or move any building or buildings or any structure or who shall put into use any lot or land in violation of any detailed statement or plan submitted hereunder or who shall refuse reasonable opportunity to inspect any premises shall be, upon conviction, liable to one or more of the following: a fine of not more than $1,250 or to imprisonment for not more than 90 days or to a period of community service of not more than 90 days. Each and every day such violation continues shall be deemed a separate and distinct violation.
B. 
The owner of any building or structure, lot or land or part thereof where anything in violation of this chapter shall be placed or shall exist and any architect, builder, contractor, agent, person or corporation employed in connection therewith who assists in the commission of any such violation shall each be guilty of a separate violation and, upon conviction thereof, shall each be liable to the fine, imprisonment, or community service specified above.
C. 
Should construction, building, excavation, clearing or use of a structure or property take place that is not in accordance with the approvals granted by the Borough and required by any Borough ordinance or without fulfillment or compliance with the conditions imposed by such approvals, such deviation shall be considered a violation of said ordinance. If, within 30 days of notification and demand by the Borough the applicant has failed to pay the fees and escrows required by this chapter or the applicant has failed to pay the inspection fees assessed pursuant to N.J.S.A. 40:55D-53h, a violation of said chapter shall be deemed to have occurred.
All development in Medford Lakes shall comply with all applicable standards and procedures of this Part 1 as well as all applicable standards and procedures of Part 2, Site Plan; Part 3, Subdivision of Land; and Part 4, Design Standards, and the administrative procedures and fees of the Borough.
This Part 1 shall take effect immediately upon final passage and publication as provided by law and the filing of a copy of it with the Burlington County Planning Board.[1]
