A. 
Any building constructed after the effective date of this law shall be required to have a fire sprinkler system approved by the Fire Inspector/Fire Marshal or his duly authorized representative before installation. The system shall meet the requirements of the National Fire Protection Association Standards as referenced in the New York State Uniform Code.
B. 
For any construction or renovation to an existing structure, or extension or increase in floor area or height of a building, or reconstruction or renewal of any part of an existing building for the purpose of its maintenance, or any combination thereof within a two-year period which exceeds 50% of a building's existing gross floor area, the entire building except for crawl spaces shall be equipped with a fire sprinkler system installed in accordance with all of the provisions of this article. The meaning of the words used in this section shall be the same as those used in the then current version of the Building Code of New York State.

No building permit shall be issued for the construction of any building required to have a fire sprinkler system under § 143-28 above, except upon a written acknowledgment by the applicant that such fire sprinkler system is required and shall be installed in accordance with plans filed and approved by the Harrison Bureau of Fire Prevention.
A. 
Fire sprinklers shall not be required to be installed in spaces where the discharge of water would be hazardous or damaging to equipment. In such places other approved fire-extinguishing equipment shall be provided, as approved by the Harrison Bureau of Fire Prevention.
B. 
Fire sprinklers shall not be required to be installed in residential accessory structures such as sheds, garages, and seasonal buildings less than 800 square feet in area for those stories above grade only.
C. 
Fire sprinklers shall not be required to be installed in non-heated, noncombustible, open-sided seasonal structures used as assembly spaces, including, without limitation, covered riding arenas, bleachers and stages.
D. 
Variance application.
(1) 
Any person shall submit an application for a variance from this Chapter 143 of the Harrison Code, together with a fee as set forth in the most current resolution of the Town Board fixing the fee pursuant to § 137-1 of the Town Code, to the Harrison Bureau of Fire Prevention. The grounds for approving such variance shall be limited to the following:

(a) 
Strict application of this chapter would cause undue economic hardship; or
(b) 
Strict application of this chapter is physically impossible.
(2) 
Within 30 days after receipt of the application, the Harrison Bureau of Fire Prevention shall transmit the application to the Zoning Board of Appeals with the Bureau's recommendation.
(3) 
Within 62 days after receipt of the application and the Harrison Bureau of Fire Prevention's recommendation, the Zoning Board of Appeals shall fix a time and place for a public hearing of the variance and shall follow the application procedures set forth in Section 235-58 of the Harrison Code. In granting any variance hereunder, the Zoning Board of Appeals shall consider requiring the applicant, as a condition of such variance, to implement alternative fire prevention measures approved by the Board.
A. 
Residential one and two-family homes: installed fire sprinkler system shall be maintained in good working order by the property owner who shall supply the Harrison Bureau of Fire Prevention with biennial inspection reports by a qualified inspector verifying that the fire sprinkler system is fully operational and in good working order.
B. 
Commercial and all other residential buildings: All other buildings are required to file annual inspection reports and permits.
Any person violating any of the provisions of this chapter shall be punishable, upon conviction thereof, by a fine not exceeding $250 per day or by imprisonment not exceeding 15 days, or both.
This Local Law (more restrictive than the Uniform Code) shall be effective immediately upon approval by the Harrison Town Board and upon filing with the office of the Secretary of State, as provided by law.
